Judge In Trump Criminal Case Delays Sentencing Indefinitely

The judge overseeing Donald Trump’s criminal hush money case ruled on Friday to delay sentencing indefinitely, granting a legal victory to the former president as he prepares for his return to the White House.

Trump, who was convicted in May on 34 felony counts for falsifying business records to conceal an alleged sexual encounter with a porn star during the 2016 election campaign, was set to be sentenced on November 26.

However, his legal team had argued that no sentencing should occur before his potential inauguration in January.

Judge Juan Merchan agreed with Trump’s lawyers, issuing an order that the sentencing be postponed indefinitely.

The ruling allows Trump to seek further legal motions, including a request to have the conviction overturned.

Trump’s defense team has invoked a landmark Supreme Court ruling that grants presidents broad immunity from prosecution for official actions during their time in office, citing this as grounds to dismiss the case.

In another significant move, Trump’s legal team also received permission from the judge to file a motion to dismiss the charges, a process that is expected to involve multiple hearings, which may be delayed once Trump is sworn in.

Separately, in a related 2020 election interference case, Special Counsel Jack Smith has moved to vacate deadlines, postponing that case indefinitely in accordance with the Department of Justice’s longstanding policy of refraining from prosecuting sitting presidents.

Trump, who has consistently called the hush money case a politically motivated “witch hunt,” faces other ongoing legal challenges, including cases related to his attempt to overturn the 2020 election results and the alleged mishandling of classified documents. Labour Party Rejects Allegations of APC Ties, Demands Apology From Deji Adeyanju

The Labour Party (LP) has vehemently denied allegations made by lawyer Deji Adeyanju in a viral video, where he claimed that the party had been “bought over” by President Bola Tinubu in preparation for the 2027 general elections.

In a statement issued by the LP’s National Publicity Secretary, Obiora Ifoh, the party condemned Adeyanju’s remarks as “criminal defamation” and demanded a public apology for the disparaging statements made about the party and its leadership, particularly its National Chairman, Barrister Julius Abure.

Ifoh dismissed the accusations as false and baseless, emphasizing that the Labour Party had never entertained any notion of forming an alliance with the ruling All Progressives Congress (APC) ahead of the 2027 polls.

He asserted that the LP remained a strong and visible opposition force, with Barrister Abure at the forefront, consistently critical of the current government.

The LP spokesman highlighted the party’s ongoing efforts to challenge the status quo since the 2023 general elections, including advocating for electoral reforms and promoting political education.

He noted that the creation of the Electoral Reform Committee and the Political Education Committee were part of LP’s efforts to strengthen democracy and encourage active citizen participation.

Ifoh also condemned Adeyanju’s “irresponsible” and “reckless” statements, calling on him to either provide evidence to substantiate his claims or retract his accusations and apologize for the damage done to the party’s reputation.

The Labour Party stressed that Adeyanju’s remarks had caused significant harm, and warned him to desist from making further damaging statements.

Ifoh reiterated that unless Adeyanju could offer proof of his allegations, the LP would consider the issue a case of defamation and demand accountability for the harm caused to the party and its members.

Supreme Court Rejects States’ Suit Challenging The Establishment Of EFCC, ICPC, NFIU, Rebukes Kogi State

The Supreme Court on Friday dismissed a lawsuit filed by several state governments, including Kogi, which sought to challenge the establishment and operational powers of Nigeria’s key anti-corruption agencies, namely the Economic and Financial Crimes Commission (EFCC), the Independent Corrupt Practices and Other Related Offences Commission (ICPC), and the Nigerian Financial Intelligence Unit (NFIU).

The court’s decision resolved longstanding debates surrounding the jurisdiction of federal agencies in investigating and prosecuting corruption cases involving state officials.

A seven-judge panel, led by Justice Uwani Abba-Aji, unanimously agreed that the suit lacked merit.

Justice Abba-Aji delivered the lead judgment, criticizing the plaintiffs for what she described as a “selfish” legal action.

She noted that Kogi State, the primary plaintiff, had brought attention to its own alleged financial misconduct by claiming that EFCC had investigated state officials, thus “opening the can of worms” and exposing itself as a “puppet” for corrupt practices.

The ruling reaffirmed the legitimacy of EFCC, ICPC, and NFIU’s powers to investigate and prosecute crimes at both the federal and state levels.

Justice Abba-Aji emphasized that, while states may establish their own anti-corruption agencies, these cannot override or conflict with the powers granted by the National Assembly to the federal agencies.

She further stated, “No state has the right to enact a law that is inconsistent with the laws enacted by the National Assembly,” thus affirming the supremacy of federal anti-corruption laws.

The suit had been filed at a time when Kogi’s former governor, Yahaya Bello, was facing multiple investigations by EFCC for alleged financial misconduct, including the diversion of billions from state funds.

While the suit progressed, EFCC filed fresh fraud charges against Bello, including allegations of embezzling over N110 billion. Despite several court summons, Bello has yet to appear in court to face the charges.

As the suit gained traction, other states, including Kebbi, Katsina, and Sokoto, joined the legal challenge, though some states like Benue and Jigawa later withdrew.

The states argued that the EFCC Act, being based on a United Nations convention against corruption, should have been ratified by a majority of state houses of assembly, as required by Section 12 of the Nigerian Constitution.

However, the court rejected this argument, clarifying that conventions do not require such ratification, and affirmed the federal government’s authority to enact such laws without state approval.

The ruling also addressed the NFIU, stating that its guidelines are legally binding. Justice Abba-Aji asserted that NFIU’s actions in regulating local government funds were within constitutional bounds, as the National Assembly’s enactments are applicable to all states.

The decision was seen as a significant win for the federal government, reinforcing the authority of federal anti-corruption bodies.

Rotimi Oyedepo, representing the Attorney-General of the Federation (AGF), expressed satisfaction with the ruling, asserting that it definitively settled the legality of the anti-corruption agencies.

However, Kogi’s Attorney-General, Abdulwahab Mohammed, acknowledged the ruling saying it would contribute to the country’s legal jurisprudence..

Court Orders APC To Maintain Status Quo In Rivers Congresses

The Rivers State High Court in Port Harcourt has issued an ex parte order requiring the All Progressives Congress (APC) to maintain the current status in its ongoing congresses in the state.

The order was issued after the party completed its ward congress and was set to proceed with the local government and state congresses.

This legal intervention followed a suit filed by APC members Okwudili Ndike, Peace Oganu, and Samuel Uchegbule, who claimed they had paid for congress forms but were not issued any.

The plaintiffs named the APC and its national chairman, Alhaji Abdullahi Ganduje, as the first and second defendants in the case.

The plaintiffs sought an interim injunction to stop the party from proceeding with the congresses.

They requested that the APC be restrained from accepting the results of the ward congress and from inaugurating its outcomes.

Justice GV Obomanu, who presided over the case, directed that all parties involved should maintain the status quo until the matter is resolved.

The case has been adjourned until December 3 for further proceedings.

“The Ministry of Foreign Affairs confirms the arrest of Mr. Simon Njoku Ekpa, a Nigerian-Finnish citizen and prominent leader of the proscribed Indigenous People of Biafra (IPOB), by Finnish authorities on Thursday, November 21, 2024,” said Kimiebi Ebienfa, spokesperson for the Ministry, in a statement.

“Ekpa has been charged with inciting terrorism and promoting violence. The Finnish District Court of Päijät-Häme has ruled to detain him on probable cause for inciting crimes with terrorist intent,” the Ministry stated.

The statement went on to underscore that Ekpa’s arrest marked an important step in curbing the activities of IPOB and neutralizing the influence of external actors on Nigeria’s security landscape.

“Given his involvement in the incitement of violence and terrorism, the Ministry of Foreign Affairs will continue to monitor the case and provide updates as the legal proceedings unfold,” the Ministry added.

The Defence Headquarters of Nigeria also commended Finnish authorities for their action shortly after the news of Ekpa’s arrest emerged.

Major General Edward Buba, Director of Defence Media Operations, and Brigadier General Tukur Gusau, Director of Defence Information, both issued statements praising the arrest as a major victory in the fight against terrorism.

“The Chief of Defence Staff (CDS), General Christopher Musa, is pleased with the arrest of Ekpa in Finland. This could be a crucial step towards his eventual extradition to Nigeria, where he will face justice,” Gusau said on Thursday.

Buba also noted that the arrest demonstrated the international community’s support for Nigeria’s anti-terrorism efforts.

“The CDS has long called for the arrest of Simon Ekpa due to his deep involvement in fueling terrorism in southeastern Nigeria. We are pleased that the international community is working with Nigeria in this battle,” Buba said.

In March 2023, the Defence Headquarters had issued a warrant for Ekpa’s arrest for his role in inciting violence in the South-East of Nigeria.

He was accused of using social media to spread separatist messages connected to IPOB, a group advocating for the secession of the southeastern region of Nigeria.

The charges against Ekpa date back to August 2021.

Finnish authorities had previously investigated him for alleged financial crimes, including raising funds through questionable methods.

President Bola Tinubu has formally written to the Senate, requesting the confirmation of Lieutenant General Olufemi Oluyede as the new Chief of Army Staff (COAS).

In a statement on Friday, presidential spokesman Bayo Onanuga explained that the request aligns with the constitutional and legal provisions of the country.

“President Bola Tinubu has sent a letter to the Senate, seeking the confirmation of Lieutenant General Olufemi Olatubosun Oluyede’s appointment as the substantive Chief of Army Staff,” Onanuga said.

The letter was sent in accordance with Section 218(2) of the 1999 Constitution and Section 18(1) of the Armed Forces Act.

Oluyede was initially appointed as the Acting Chief of Army Staff on October 30 after the illness of Lieutenant General Taoreed Lagbaja.

However, General Lagbaja passed away on November 5 and was laid to rest in Abuja.

The presidential spokesman expressed President Tinubu’s confidence in Oluyede’s leadership abilities, professional integrity, and wealth of experience to effectively lead the army and contribute to national security and stability.

ICPC Begins Monitoring N41bn Constituency, Executive Projects

The Independent Corrupt Practices and Other Related Offences Commission (ICPC) has initiated the tracking of 106 constituency and executive projects worth ₦41 billion across Kano State.

Barr. Ibrahim Garba, the ICPC Kano State Resident Anti-Corruption Commissioner, announced the commencement of the monitoring process in a statement to the press.

He disclosed that 99 of the projects are constituency-driven, while the remaining seven are executive projects, all spread across the state’s 44 local government areas.

Garba emphasized that the goal of the tracking initiative is to ensure that the projects are executed according to their specifications, providing tangible benefits to the people, minimizing waste, and preventing corruption.

He called on local residents to actively engage in the monitoring process by reporting any discrepancies in the project execution and taking ownership of projects in their communities.

“The ICPC has focused on key sectors that directly impact the lives of citizens, such as education, health, agriculture, water supply, rural roads, power, and youth empowerment,” Garba noted.

Additionally, Garba highlighted that the Commission would collaborate with key stakeholders, including the media, the Nigerian Institute of Quantity Surveyors (NIQS), the Bureau of Public Procurement (BPP), the Office of the Accountant General of the Federation, and civil society organizations, to ensure the successful monitoring of the projects.

Russia requires migrants to fill its growing labour shortages, Kremlin spokesperson Dmitry Peskov stated in an interview published Friday.

He acknowledged that the country’s demographic challenges were creating obstacles to national development.

“Migrants are a necessity,” Peskov said, speaking to the state-run news agency RIA Novosti.

“We have a tense demographic situation. Despite being the largest country in the world, our population is relatively small.”

The comments come after the Russian parliament recently approved a controversial law banning “child-free propaganda,” aimed at addressing the country’s declining birthrate by discouraging people from opting not to have children.

The legislation is part of a broader effort to tackle Russia’s demographic crisis, which has been exacerbated by the ongoing war in Ukraine.

“We need a workforce for dynamic development and to carry out our national projects,” Peskov continued, underscoring the government’s need for migrant workers.

He noted that Russia is open to migration to address its labour needs.

While there is official recognition of the need for migration, anti-migrant sentiment is prevalent in Russia, especially towards workers from Central Asia, who make up a significant portion of the labour force in various sectors.

In July, the Kremlin warned that Russia’s declining population poses a “disastrous” risk to its future.

The country’s population has been in decline since the fall of the Soviet Union, despite efforts by the government, such as generous subsidies and mortgage programs, to encourage larger families.

Russia’s demographic crisis is compounded by a low birthrate, which stood at 1.41 births per woman in 2023, well below the replacement rate of 2.0.

The country also faced high Covid mortality rates and the loss of hundreds of thousands of men who fled the country to avoid conscription into the Ukraine conflict.

According to Rosstat, Russia saw a 3.4 percent drop in the number of births during the first nine months of 2024, with only 920,200 babies born, the lowest number since the 1990s.
