Again, Court Bars Emir Bayero From Renovating Palace

A Kano State High Court has once again issued an order restraining the 15th Emir of Kano, Alhaji Aminu Ado Bayero, from renovating the Nassarawa Mini Palace.

The ruling was delivered on Thursday following an ex-parte motion filed by the Kano State Government, the Attorney General of Kano, and the Kano Emirate Council, through their counsel Rilwanu Umar SAN.

The motion was dated September 12, 2024.

The applicants sought a court order to halt Emir Ado Bayero’s renovation efforts at the mini palace.

In her ruling, the presiding judge and Chief Judge of Kano State, Justice Dije Abdu Aboki, found the application meritorious and granted the interlocutory injunction.

She noted that the respondent had not filed any counter affidavit or written argument opposing the application.

“It is pertinent to note that the respondent filed no counter affidavit nor written address challenging the applicant,” Justice Aboki stated before referring the case to High Court 15 for further mention.

Earlier, the applicants’ counsel, Rabiu Ibrahim-Yaura, informed the court that Emir Ado Bayero had been deposed under the Kano State Emirate Council Repeal Law of 2024.

Despite being served with the court papers on September 14, the respondent did not submit any defense or appear in court.

The applicants also asked the court to declare the Nassarawa Mini Palace as property belonging to the Kano State Government and the Emirate Council, and not a personal property of the Emir.

Reps Pass Bill To Allow FRSC Officers Carry Guns

The House of Representatives has passed a bill for the second reading that seeks to establish a special armed squad within the Federal Road Safety Corps (FRSC).

The bill, sponsored by Rep. Abiodun Derin Adesida and Rep. Olaide Lateef Muhammed, aims to amend the FRSC Act of 2007 to enhance the agency’s operations and provide additional powers.

If passed, the bill would allow FRSC officers to carry firearms, specifically forming a Special Armed Squad.

It also proposes that officers holding the rank of Deputy Corps Marshal should receive benefits tied to their rank, including retirement packages.

Furthermore, the bill seeks to empower the FRSC with full responsibility for road traffic administration, traffic crash prevention, supervision of road users, and regulation of traffic on public roads.

The proposed legislation also gives the FRSC authority to clear road obstructions and educate the public on road safety practices.

After a voice vote, the members of the House unanimously supported the bill’s passage for a second reading.

In a related development, the House adopted a motion by Garba Ibrahim Muhammad, urging the FRSC to embrace modern technology in its operations.

The motion called for the use of Automatic Vehicle Location systems, Automated Traffic Enforcement systems, and advanced data platforms to improve road safety and reduce traffic violations.

The House referred the motion to the Committee on FRSC for further action.

Six Kidnapped Journalists Regain Freedom

Police in Anambra State have successfully rescued six sports journalists who were kidnapped by suspected criminals in the Isseke community of Ihiala Local Government Area.

The journalists were traveling to Uyo, Akwa Ibom State, to cover the Nigeria vs. Libya African Cup of Nations qualifying match when they were abducted on Wednesday along the Isseke-Orlu Road.

The rescue was confirmed on Thursday by SP Tochukwu Ikenga, the spokesperson for the Anambra State Police Command.

He stated that joint security forces had worked together to free the six journalists, while efforts continue to locate and rescue the seventh member of their crew.

“Joint security forces have rescued six members of the media crew who were abducted while traveling from Lagos to Uyo,” Ikenga said in his Thursday statement.

He assured the public that operations are ongoing to secure the remaining journalist’s release and to bring the kidnappers to justice.

Former Minister of Transportation, Rotimi Amaechi, has voiced his frustration over the public’s lack of action in response to the ongoing economic hardships in Nigeria.

Just In: Appeal Court Adjourns IPOB’s Case

The Court of Appeal in Abuja has postponed the hearing of the Indigenous People of Biafra (IPOB)’s appeal against its designation as a terrorist group by the Nigerian government.

The hearing is now set for October 31.

The three-judge panel instructed both sides to submit all necessary legal documents before the next session.

IPOB’s appeal challenges the Federal High Court’s 2017 ruling, delivered by the late Justice Abdul Abdu-Kafarati, which banned the group and labeled its activities illegal.

The court made this decision following an ex-parte motion filed by the Attorney General of the Federation (AGF), Abubakar Malami, SAN, on behalf of the government.

Justice Kafarati further instructed that the order be published in the official gazette and in two national newspapers.

In January 2018, IPOB’s attempt to contest the proscription was rejected. The court upheld its earlier ruling, stating that the group posed a threat to national security.

IPOB’s lawyer, Ifeanyi Ejiofor, had argued that IPOB was not a registered entity in Nigeria and, therefore, could not be legally banned.

However, the court dismissed this argument, stating that even if IPOB was registered in other countries, it could still face legal action in Nigeria.

IPOB contends that Justice Kafarati’s ruling was flawed and that the group’s activities do not meet the legal definition of terrorism.

They said that IPOB is a non-violent movement advocating for self-determination, in contrast to violent groups such as the Fulani herdsmen, which have not been labeled as terrorists.

The group is seeking to have the proscription order overturned.

The detained leader of IPOB, Nnamdi Kanu, has also applied to be joined as an interested party in the case.

Fuel Price Jumps To N1,030 Per Litre

The Nigerian National Petroleum Company Limited (NNPC) has raised the pump price of Premium Motor Spirit (PMS) to N1,030 per litre at various outlets in Abuja as of Wednesday.

This increase follows NNPC’s recent decision to terminate its exclusive purchasing agreement with Dangote Refinery, which previously allowed NNPC to be the sole buyer of petrol from the refinery.

With the agreement now ended, other marketers can directly negotiate and purchase petrol from Dangote Refinery, signaling a shift towards a more competitive market.

This change aligns with the principles of a fully deregulated fuel sector, where products are sold based on a “willing buyer, willing seller” model.

Just last month, NNPC raised the fuel price to N855 per litre in Lagos and N897 in Abuja. The company reported purchasing petrol from Dangote Refinery at N898.78 per litre and selling it to marketers at N765.99 per litre, resulting in a subsidy of nearly N133 per litre, which NNPC indicated it can no longer maintain.

Senate Orders Governors, State Assemblies To Enforce Supreme Court Ruling On LG Autonomy

The Senate has directed state governors and Houses of Assembly to comply with the Supreme Court ruling on local government autonomy, particularly in relation to the financial independence of the 774 local councils in Nigeria.

This follows a closed-door session held on Wednesday, where senators debated efforts by some state governments to obstruct the enforcement of the July 11 ruling.

Deputy Senate President, Barau Jibrin, announced the resolutions after the session, emphasizing the Senate’s plan to amend sections of the 1999 Constitution to provide full autonomy to local government administrations across the country.

The Supreme Court ruling, which granted local governments autonomy, was delivered after the federal government, through the Minister of Justice and Attorney General, filed a suit.

The judgement is intended to liberate local councils from financial dependence on state governments.

Senator Tony Nwoye (LP, Anambra North), during the plenary, raised concerns under Senate orders 41 and 51, alleging that some state governors were influencing state Assemblies to pass laws that would require local governments to continue remitting funds into a joint state/local government account, in violation of the Supreme Court’s judgement. Nwoye’s motion was co-sponsored by 10 other senators.

However, Senator Adamu Aliero (PDP, Kebbi Central) countered that the Supreme Court ruling was enforceable nationwide and urged the Senate not to deliberate on the matter, citing the constitution.

Senate President Godswill Akpabio echoed Aliero’s point, referencing Section 162 (6) of the 1999 Constitution, which stipulates that the Supreme Court’s ruling should be upheld.

The debate eventually led to the emergency closed-door session, after which the Senate called on all state governments and legislative bodies to respect the Supreme Court’s decision.

Additionally, the Senate resolved to pursue constitutional amendments to guarantee the financial autonomy of local governments, ensuring they are no longer reliant on state authorities for funding.
