The Federal High Court in Kano has issued an injunction preventing executive members of the All Progressives Congress (APC) in Ganduje Ward, Dawaki Tofa Local Government Area, from taking further action regarding the suspension of APC national chairman, Abdullahi Umar Ganduje.

Justice Abdullahi Muhammad Liman granted an interim order directing the respondents to refrain from implementing or enforcing Ganduje’s suspension.

This decision came after an emergency meeting of the APC executive members of Ganduje Ward on April 15.

The injunction will remain in place pending the hearing and determination of Ganduje’s fundamental right of fair hearing filed before the court.

The court also instructed all parties to maintain the status quo before the emergency meeting and to abstain from any action related to the matter until a verdict is reached.

Justice Liman scheduled April 30 for the hearing in the case.

Ganduje’s legal representative, Jazuli Mustapha, submitted the application supported by an affidavit sworn to by Suleiman A. Suleiman.

Yahaya Bello Seeks Annulment of Arrest Warrant In Abuja Court

Former Kogi State Governor, Alhaji Yahaya Bello, has petitioned the Federal High Court in Abuja to nullify an arrest warrant issued against him.

Represented by his lawyer, Abdulwahab Mohammed, SAN, Bello argued that the court lacked jurisdiction to issue the warrant.

Advertorial

Mohammed made the submission before Justice Emeka Nwite during the scheduled arraignment of the ex-governor by the Economic and Financial Crimes Commission (EFCC) on a 19-count money laundering charge.

The court had granted the EFCC’s request for a warrant following Bello’s failure to appear on Wednesday.

Justice Nwite ordered Bello’s appearance on Thursday for plea-taking.

Mohammed informed the court of a pending preliminary objection challenging the arrest warrant.

He also cited a High Court of Kogi’s order from February 9, restraining the EFCC from arresting, detaining, or prosecuting Bello.

The EFCC had appealed this order, with the matter set for hearing.

Mohammed argued that the EFCC’s procurement of the arrest warrant was an attempt to undermine the appellate court’s authority.

However, EFCC’s lawyer, Kehibde Pinhero, SAN, disagreed, asserting that Bello’s arraignment was on the day’s agenda. Pinhero contended that since Mohammed had appeared for Bello, the service of the warrant could proceed in court.

Pinhero emphasized that the warrant was necessary to ensure Bello’s presence in court, as previous attempts to serve him had failed.

The hearing is ongoing as of the time of reporting.

Yahaya Bello’s Absence In Court Leads To Adjournment As EFCC Considers Military Assistance

The Federal High Court in Abuja, presided over by Justice Emeka Nwite, has adjourned the case brought by the Economic and Financial Crimes Commission (EFCC) against former Governor of Kogi State, Yahaya Bello, to April 23rd.

The adjournment aims to facilitate substituted service and potential arraignment of Bello over allegations of N84 billion money laundering.

Advertorial

During the latest session, EFCC’s Counsel, Kemi Phinro, informed the court of Bello’s absence, attributing it to the protection provided by an individual with immunity.

Phinro disclosed that Bello was reportedly taken from his Abuja residence by the same individual with immunity.

Expressing concern over Bello’s evasion, Phinro hinted at the possibility of the EFCC seeking assistance from the military to apprehend him.

Court Fixes Date For Ruling On Nnamdi Kanu’s Demands

Aloy Ejimakor, the Lead Counsel for Nnamdi Kanu, the detained leader of the Indigenous People of Biafra (IPOB), has responded to the conditions presented before Kanu faces the treasonable felony charges brought against him by the Federal Government.

Ejimakor emphasized the validity of the demands, citing the constitutional provision that guarantees fair hearings before subjecting individuals to trial.

Advertorial

Addressing journalists after the proceedings at the Federal High Court in Abuja, Ejimakor highlighted the significance of ensuring Kanu’s rights are upheld.

He mentioned that while Kanu’s legal team has access to him in the custody of the Department of State Services (DSS), this access is closely monitored, which violates Section 36 of the Constitution.

Kanu had demanded the restoration of the bail previously granted to him by the court, asserting that his continued detention hinders his ability to adequately prepare his defense against the FG’s allegations.

He argued that his bail was revoked based on false representations by the FG and that he never violated his bail conditions before security agents raided his home.

Ejimakor emphasized the importance of upholding constitutional rights, particularly in cases where charges carry severe penalties.

He stated that the defense team’s stance aligns with Section 36 of the constitution, which mandates fair trials for all Nigerians.

Justice Binta Nyako has scheduled May 20 to rule on the matter, indicating a pivotal moment in Kanu’s legal battle.

PDP NEC Meeting: Osita Chidoka Warns Of Party’s Demise Over Wrong Decisions

Former Minister of Aviation and prominent PDP member, Osita Chidoka, has issued a stark warning ahead of the National Executive Committee (NEC) meeting of the Peoples Democratic Party.

Chidoka cautioned that any misstep during the meeting could spell disaster for the party.

Advertorial

In a statement released on Wednesday, Chidoka directed his message to PDP governors and the National Assembly Caucus, emphasizing the critical importance of upholding the party’s constitution.

He stressed that any attempt to disregard the party’s constitutional principles could have catastrophic consequences, potentially leading to the downfall of the party.

The upcoming NEC meeting is set to address the issue of whether the current acting National Chairman, Umar Damagum, should continue in his role or be replaced.

Damagum assumed the position following the suspension of Iyorchia Ayu by a court in Benue State in March 2023.

While some within the party advocate for electing a member from the North Central to complete Ayu’s tenure in accordance with the party’s constitution, others support Damagum’s candidacy for the substantive chairman position.

Chidoka expressed grave concern over the direction the party might take at the NEC meeting. He warned that failure to prioritize constitutional adherence and respect for the party’s rules could lead to dire consequences.

He also urged the party to refocus on providing good governance and principled opposition, essential for earning the trust of Nigerians.

Chidoka concluded by underlining the urgency of addressing the internal challenges within the party to safeguard its integrity and relevance in Nigeria’s democratic landscape.

Court Allows Substituted Service For DNA Test On Mohbad’s Wife

A Magistrate Court in Ikorodu, Lagos has approved serving notice of a pending DNA test application to Wunmi, the wife of the late singer, Ilerioluwa Aloba, popularly known as Mohbad, via substituted means.

This decision came after unsuccessful attempts to personally serve her by the court sheriff.

Advertorial

The Aloba family is disputing the paternity of baby Liam and has petitioned the Family Court to compel Wunmi to undergo a DNA test.

The family’s legal team, representing Joseph Aloba, the late singer’s father, sought an order to serve Wunmi the court papers for the DNA test by posting them at her last-known address.

Monisola Odumosu, a member of the Aloba family’s legal team, explained that this method of service would ensure Wunmi is aware of the pending suit.

The Chief Magistrate granted the order for substituted service, directing the court process to be posted at her last-known address.

In response to the court order, Wunmi, in a viral video, expressed readiness for the DNA test but had not been available for personal service by the court sheriff.

The matter has been adjourned to the following month for the report of service.

Meanwhile, counsel to Wunmi, Taiwo Olawanle, claimed unawareness of the court order and stated willingness to advise Wunmi to comply if provided with the order.

Mohbad passed away at the age of 27 under controversial circumstances in September 2023.

His body was exhumed for autopsy, and the Lagos State Police Command inaugurated a special investigation team to probe his death, leading to the arrest of Naira Marley and Balogun Eletu, among others.

At the recent session of the Coroner’s inquest into Mohbad’s death in March 2024, Dr. Richard Somiari of the Lagos State DNA and Forensic Centre assured that autopsy results would be ready within the next three to four weeks.

Examining EFCC’s Jurisdiction To Prosecute Naira Mutilation Cases

By VO Nwadike Esq, Principal Counsel Pristine & Sage Attorneys

The tradition of spraying naira notes at social gatherings in Nigeria has recently come under scrutiny, with the Economic and Financial Crimes Commission (EFCC) initiating crackdowns on this practice.

Advertorial

Section 21 (1) of the Central Bank Act (CBN) Act 2007 provides that a person who tampers the Naira note is guilty of an offence and liable to conviction for a term not less than 6 (six) months or a fine not less than N50,000.00k (fifty thousand naira) or both the fine and imprisonment. S. 21 (2) further provides that the Naira is deemed to have tampered if it has defaced or willfully abused. For the avoidance of doubt S. 21(3) states that spraying of and dancing on the Naira during social occasion or otherwise shall constitute an abuse and defacing of the Naira.

Despite the clear provisions of the CBN Act 200, skepticism persists regarding the EFCC’s prioritization of naira mutilation cases over more pressing issues like political corruption and embezzlement. This situation underscores the clash between legal mandates and cultural norms, leading to accusations of improper prosecutorial discretion. When societal practices seemingly contradict the law, enforcement becomes complex, as evidenced by the dearth of prosecutions for offenses like bigamy in Nigeria.

Advertorial

Nonetheless, the jurisdiction of the EFCC to prosecute the offence of mutilation of Naira can be subjected to legal scrutiny. The EFCC is a creation of the EFCC (Establishment) Act 2004, which set up a national anti-graft agency charged with the responsibility of enforcement of all economic and financial crimes in Nigeria. In the landmark case of Dr Joseph Nwobike (SAN) v. Federal Republic of Nigeria (SC/CR/161/2020), the Nigerian Supreme Court was compelled to consider the ambit of the prosecutorial powers of the EFCC.

After due appraisal of the provisions of the United State Convention Against Corruption (UNCAC), vis-a-vis Section 46 of the said EFCC Act, the Supreme Court opined that the prosecutorial powers granted to the EFCC over economic and financial crimes was not open-ended but limited strictly to instances where the conduct was committed with the objective of earning wealth. In that case, the Supreme Court came to the irresistible conclusion that the offence of ‘attempt to pervert the course of justice’ which the Appellant was convicted for, where it has not been shown that it was committed with the objective of earning wealth, was outside the remit of the EFCC to prosecute.

In view of the decision of the Supreme Court in Nwobike’s, the case can be strenuously made that the EFCC lacks the jurisdictional powers to prosecute the offence of spraying of naira notes under S.21 of the CBN Act, being conduct not committed with the purpose of illicitly acquiring wealth.

It is imperative for agencies like the EFCC to strictly adhere to their legal mandates and jurisdictional boundaries when prosecuting crimes. This ensures fairness, legality, and accountability in their actions, preserving the integrity of the justice system.

In conclusion, while the EFCC plays a crucial role in combating economic and financial crimes, its jurisdiction must be exercised judiciously and in accordance with the law. By prioritizing cases that align with its statutory mandate, the EFCC can maintain public confidence and uphold the principles of justice and fairness.

PDP’s NEC Meeting Pits Governors, Atiku, Wike In Battle For Party’s Future

As the Peoples Democratic Party (PDP) prepares for its highly anticipated National Executive Committee (NEC) meeting today, tensions run high amid uncertainty over the party’s direction and leadership.

The gathering is overshadowed by a power struggle among key stakeholders vying to influence the party’s trajectory ahead of the 2027 general elections.

Advertorial

Unlike previous contests primarily between former Vice President Atiku Abubakar and FCT Minister Nyesom Wike, the dynamics have shifted.

State governors, particularly those in their second terms, have emerged as a formidable bloc seeking to assert control.

Among the influential governors are those from Adamawa, Akwa Ibom, Bauchi, Bayelsa, Delta, and Edo states, with some already serving their second term.

Their collective agenda appears focused on shaping the party’s future and positioning themselves for political dominance.

However, internal divisions and conflicting interests within the governor’s forum have hindered cohesive action, impeding their efforts to present a unified front.

Meanwhile, the ongoing feud between Atiku and Wike persists, with both camps maneuvering to consolidate power within the party.

Atiku’s loyalists advocate for key positions within the National Working Committee (NWC) to bolster his influence, while Wike maintains control over the current leadership, viewed as loyalists.

The recent vote of confidence passed by the NWC on the acting chairman, Umar Damagum, underscores the tug-of-war within the party.

Atiku’s camp pushes for a new chairman to spearhead party reorganization, while Wike’s faction seeks to maintain the status quo.

The North Central Caucus, in a bid to assert its influence, insists on producing the next national chairman, citing constitutional provisions. The region’s determination to uphold party rules challenges attempts to prolong Damagum’s tenure.

Former chairman Senator Iyorchia Ayu’s withdrawal of his appeal suit against the party clears the path for decisive action on the chairmanship position. Stakeholders in the North Central now rally behind Gabriel Suswam as Ayu’s potential successor.

Amidst these internal power struggles, the PDP’s NEC meeting holds significant implications for the party’s cohesion and electoral prospects.

The outcome will shape its trajectory and determine its ability to present a united front ahead of the upcoming elections.
