BREAKING: Enugu Tribunal Reserves Judgment In Labour Party’s Petitions Against Peter Mba, Others

The Enugu State Governorship Election Petitions Tribunal has reserved judgment in the petitions against the election of Governor Peter Mbah.

Honourable Justice Akano who led the tribunal, said it would communicate a date for judgment to the parties after counsels adopted their final written addresses on Wednesday.

Advertorial

The candidate of the Labour Party, Barr. Chijioke Edeoga is challenging the return of the PDP’s governorship candidate, Peter Mba by the Independent National Electoral Commission (INEC) in the March 18 governorship elections in the State.

While the petitioners (Barr. Edeoga and Labour Party) were present in court, the second respondent (Peter Mba) was absent in court on Wednesday.

INEC is the first respondent in the petition, Mr. Mbah and PDP are listed as the second and third respondents respectively.

Adopting his address, Peter Mbah’s counsel, Chief Wole Olanipekun, SAN, asked the court to dismiss the Petitions of the Labour Party for lacking in merit and a mere academic exercise.

Similarly, counsel to the Peoples Democratic party, Anthony Ani, SAN, contended that the argument of the petitioners are vague and lacking in evidence.

Adopting his final address, Chief Adegboyega Awomolo, SAN, lead counsel to Labour Party and its governorship candidate, asked the tribunal to hold the position of his clients and grant the reliefs sought because it has been established beyond any reasonable doubt that Mr. Peter Mba was at the time of the election not constitutionally qualified to contest having presented forged certificate of national service to INEC.

Chief Adegboyega Awomolo further argued that Mr. Peter Mba of the PDP did not win the majority of lawful votes cast during the election as there was over-voting in polling units of Owo ward, Ugbawka ward 1 and 2, computational errors in Udenu Local Government Area, Enugu East, use of thugs to stall vote counting, non use of BVAS, substantial non compliance with the electoral act among other proven irregularities.

Daily Gazette recall that the electoral umpire, INEC had declared Peter Mba of the PDP winner of the keenly contested March 18 governorship elections in the state.

Some Lawyers Attempting To Bribe Judges In My Team With N10m – Kano Tribunal Judge Raises Alarm

The Chairperson of Panel 2 of the Election Petition Tribunal, sitting in Kano, Justice Azinge on Tuesday raised the alarm that some lawyers were attempting to bribe judges in her team.

According to her, this was the second time a judge was complaining about how some lawyers prosecuting election matters before her tried to corrupt the system by offering bribes to her and her colleagues.

She stated in the open court on Tuesday that, “money is flying”, adding that “it’s being rumoured that a staff collected N10 million.”

However, she did not elaborate on if the staff who collected the bribe was in her court or another court.

She however warned that she would not take kindly to any further attempt to pervert the course of justice through corruption.

“In recent years, allegations of lawyers bribing judges cast shadows over Nigeria’s judicial system, a complex issue that is threatening to erode the public’s trust in the pursuit of justice.”

Advertorial

“While it is important to acknowledge that not all lawyers engage in unethical practices, the spectre of judicial corruption remains a concerning challenge that the Nigerian legal community must confront head-on.”

The concept of lawyers bribing judges highlights the intersection of power, ethics, and accountability within the Nigerian legal landscape.

“Corruption within the judiciary undermines the very essence of a fair and impartial legal process, eroding the foundational principles upon which justice is built. The consequences are far-reaching, affecting individuals, communities, and the overall integrity of the rule of law.”

Reports of lawyers attempting to sway judicial decisions through illicit means underscore the need for comprehensive reforms.

The Nigerian legal fraternity is tasked with introspection and self-regulation to identify and address the root causes that may foster such unethical behaviour. Transparency, accountability, and commitment to upholding the rule of law are vital components in dismantling the culture of corruption, which threatens to undermine the credibility of the justice system.

“Efforts to combat judicial corruption should involve not only legal professionals but also civil society organisations, academia, and governmental bodies.

“Strengthening mechanisms for reporting and addressing allegations of corruption, ensuring the independence of the judiciary, and enhancing ethical training for lawyers are crucial steps in creating a more robust and trustworthy legal ecosystem.”

Contacted for his reaction over the allegation that some lawyers were attempting to bribe some EPT judges, the Kano State Nigeria Bar Association Chairman, S. S. Gezawa, said he read the report in an online newspaper that the Chairperson of the Kano EPT, Justice Azinge alleged that some lawyers were attempting to bribe some judges.

He added that rumour had it that one of the court officials received the sum of N10 million, as a bribe.

“I’ll say, it is what it is, it is an allegation, if any member of the EPT or my Lord, the Chairperson of the panel, Justice Azinge, has any allegation or proof of evidence of such, it can be formalised, a complaint can be channelled to the NBA or to the Legal Practitioners Disciplinary Committee for necessary action against the erring lawyer”

“We should also remember that lawyers are not immune to prosecution.”

To this extent, the NBA boss argued that if there is any concrete evidence against any lawyer that he has erred, it can be reported to any of the Security agencies, especially the Anti-Corruption Agencies, the police, the EFCC or the ICPC, if it involves a staff or public servant.

“So long as it has not been formalised, we will see, as my lord said, it is rumours and allegations, that is what it is”, he added.

Sanctions On Niger Remains – ECOWAS Reply Northern Elders

President Bola Ahmed Tinubu has said the Economic Community of West African States (ECOWAS) will follow its sanctions against the military junta in the Republic of Niger to the letter.

But the Northern Elders Forum (NEF) advised President Tinubu, who is also Chairman of the ECOWAS Authority of Heads of State and Government, to urgently withdraw all sanctions imposed on Niger Republic to ease negotiation.

Advertorial

Nigeria had on August 4 closed all its borders with Niger and cut off electricity supply to the country following the refusal by the junta to reinstate detained President Mohamed Bazoum whose government was toppled on July 26.

The military rulers had recently expressed their readiness to dialogue with ECOWAS on the crisis.

United States Secretary of State, Antony Blinken said he still sees a chance for diplomacy to reverse a coup in Niger.

Military chiefs from ECOWAS will meet in Ghana this week to discuss possible intervention in Niger.

President Tinubu said ECOWAS was working to keep the sanctions in place.

The president said this yesterday when he received the Special Envoy of President Ali Bongo Ondimba and the Minister of Foreign Affairs of the Republic of Gabon, Mr. Hermann Immongault, at the State House, Abuja.

He praised the solidarity of the Economic Community of Central African States (ECCAS) on the political impasse in the Republic of Niger.

President Tinubu said the special message of support and solidarity from President Bongo, who doubles as the Chairman of ECCAS, expressing the full support of ECOWAS resolutions on the unconstitutional takeover of government in Niger, proved once more that military interference in democratic governance was not acceptable anywhere, and certainly, no longer so on the African continent.

He said, “We are working not to compound the problem. We have well-meaning people who have intervened.

“I understand the fear of our people on any form of military action. We are working to keep the sanctions in place and we are following them to the letter.

“We are happy to know that ECCAS is with us on this. Interference in democratic governance is not acceptable to ECOWAS.”

Tinubu promised to work with President Bongo and ECCAS to restore constitutional order in Niger.

He reinforced the position of the regional body not to accept any attempt by the military junta in Niger to intimidate and harass President Mohamed Bazoum.

In his remarks, the Special Envoy commended the leadership of ECOWAS and President Tinubu for the steps taken so far to restore democracy in Niger, adding that President Bongo and ECCAS are fully in support of all ECOWAS resolutions.

“President Bongo has been following your efforts and those of other ECOWAS leaders on the situation in Niger. President Bongo and ECCAS strongly condemn the coup in Niger.

“With Boko Haram attacks in Cameroon, piracy in the Gulf of Guinea and the refugee situation in Chad, whatever happens in West Africa affects Central Africa. My President joins efforts with you and ECOWAS to find a solution to the crisis in ECOWAS,” he said.

HARDSHIP: Families Passing Through Difficult Times As Food Prices Keep Soaring Unabated

Families in Nigeria are passing through difficult times as the cost of staple food is increasingly becoming unbearable.

Findings at various markets across the country show that prices of rice, beans, garri, flour and sugar, among others, are rising almost on a weekly basis.

While breadwinners are seeking government’s help; traders are lamenting that the inflation rate is fast eroding their capital base.

The latest inflation figure was 24.08 per cent in July 2023, the highest since September 2005.

Kogi, Lagos, Bayelsa pay more for food as inflation hits 24.08%

After Tinubu, CBN governor’s meeting, dollar crashes to N790 at parallel market

A March report by the Food and Agricultural Organisation (FAO) showed that nearly 25 million Nigerians were at risk of hunger between June and August unless urgent actions are taken.

Advertorial

FAO identified continued conflict, climate change, inflation and rising food prices as key drivers of the trend.

It said, “Of the 17 million people who are currently food insecure, 3 million are in the north-east Borno, Adamawa and Yobe states.

“Without immediate action, this figure is expected to increase to 4.4 million in the lean season. This includes highly vulnerable displaced populations and returnees who are already struggling to survive a large-scale humanitarian crisis in which 8.3 million people need assistance.”

Our report indicates that food prices for a period of six-month (February-July 2023) have hit rooftops.

Available records showed that by mid-February to the end of July, prices of maize, beans and rice from three-grain markets of Dawanau, Dandume and Kumo in Kano, Katsina and Gombe states as well as Abuja had on average doubled, especially maize; while beans and rice added N10,000 and N20,000 respectively.

According to the prices index, the prices of the items kept soaring unabated almost every week to the current staggering level.

As of July 29, 100kg of maize sold for N41,000; 100kg of beans, N46,000; and 100kg of rice, N77,000.

But checks last week and this week at a famous maize market in Dandume, Katsina State, showed that the price of 100kg of maize had risen to N52,000 per 100kg.

A grain buyer and seller at the market, Ya’u Dauda, told our correspondent that at Funtua and Giwa markets that the prices of the commodity were also on the rise as 100kg bag sold for N53,000 at Funtua and N52, 000 at Giwa.

There are similar reports at the weekend at Dawanau market where the price had risen to about N50,000 per 100kg.

Curiously, in February, these grains sold for N19,000, N38,000 and N59,000, respectively.

Spaghetti;
In February, crown spaghetti sold for N5,000, but hit N5,500 in March; N5, 550 in April and N5,700 in May.

Sugar;
The price of Dangote sugar in February was N29,000; N32,000 in March; N32, 300 in April; N37, 800 in July and N42,200 at present.

Flour;
The price of Golden Penny flour was N27,000 in February; N28,300 in March; N28,500 in April; N28,500 in June and N31,200 at present.

‘Toughest time in our lifetime’

Abdulrahman Lawal, a trader and father of many children in Zaria, who called for intervention through a price regulatory agency, said he now focused on essential demands only.

He said: “Food has become a sacred commodity now. I’m no longer concerned about children’s school fees. If we get one meal a day for the family, we just thank God.

“In my house now, we boil sweet potatoes because it doesn’t require any ingredients to cook. Maize is out of my reach and poor families, let alone rice and beans.

“Government should intervene and put price control on essential commodities, the same way they regulated the fuel market before removing the subsidy; that is the alternative.’’

Another trader and artisan, Malam Murtala Abdulrazaq, said: “N5,000 could hardly sustain me a day because even a mudu of rice is more than N2,000; while sometime ago, I could sustain my life at N1,500 in a day. I cannot afford to buy maize flour now. Instead, I buy garri to prepare eba, which is more affordable because it’s less expensive. Getting three square meals is no longer feasible.”

A resident of Abuja, Azeez Ramat Kikelomo, said a 100kg bag of beans, which sold for N39,000 in February, ws now N80,000.

She said in February, maize, which sold for N19,000 at Bwari market now sold for N45,000.

Kikelomo, a civil servant, pleaded with the government at all levels to find the solution to the continued rise in the prices of foodstuffs.

Situations in S/West, S/East, S/South

Food items like local rice, garri, yam, tomato, bread, plantain, vegetables, fish, beans and others have recorded more than 25 per cent increase between February and July in the South.

Mrs Ibiyemi O, a rice seller at Bodija market, Ibadan, said a bag of rice, which sold for between N27,000 and N28,000 in February, was now N45,000 and above. A bag of beans, which sold for N37,000 in February, is now N47,000.

A medium-sized tuber of yam, hitherto sold in the range of N700-N800 now costs between N1,200 and N1,500.

In Lagos, a loaf of bread, which sold for N600 in January, is now between N800 and N1,000.

The price of a crate of eggs has also risen from N1, 200 to N2, 500 for the big size; and the small size, N2, 200.

At Sunday market in Ogba, a paint bucket of garri has hit N2,000 from N800 earlier in the year.

In Abakaliki, a medium paint of beans now costs between N2, 500 and N2, 700 from N1, 600-N1, 800 depending on the species.

A trader, Chigozie Ogbonna, blamed the high cost of foodstuffs on activities of the task force on major highways in the zone.

“If you travel along the Abakaliki-Ikom Road, you’ll see the task force checking and collecting money from vehicles transporting food items. This also contributes to the high cost of food items.”

In Uyo, a cup of rice sold for between N200 and N250 depending on the type as against the N150 and N180 earlier in the year.

ENUGU: Owo Youths In Nkanu East LGA Protest Against Alleged Land-Grabbing By Traditional Ruler

Dozens of youths from Governor Peter Mbah’s Owo community in the Nkanu East Local Government Area of Enugu State on Tuesday stormed the streets to protest against alleged land-grabbing and high-handedness of their traditional ruler, Igwe Okeke Arum and former President General of the town, Mr. Okeke Akpu.

In a viral video on Tuesday, the protesting youths chanted solidarity songs and displayed placards bearing different inscriptions including: “Okeke Arum, leave Owo Kingdom alone”, and “Okeke Arum mind Mburu Owo Autonomous Community.”

The protesting youths

The youths also marched around the community to register their annoyance with the traditional ruler, and a former President General of Owo Town Union, Mr Okeke Akpu.

Speaking, the current President General of Owo Town Union, Prince Augustine Nnajieze, said their protest is against alleged atrocities committed by Igwe Godwin Okeke Arum, including turning the Community Neighbourhood Watch into his thugs with which he harasses and intimidates anybody that speaks against his actions.

Nnajieze said, “Okeke Arum is not the Igwe of Owo, but the Igwe of Mburu Owo Autonomous Community, yet he is forcing himself on the entire community. This man has committed so many atrocities in Owo Town, that he has turned the Enugu State Neighbourhood Watch into his security and thugs. He uses the Neighborhood Watch to harass, intimidate and kill anybody who disagrees with him.

“The Owo Community has no traditional ruler, but he wants everybody to come and bow to him. The very moment you don’t accept to bow before him, you become an enemy.

“Igwe Okeke Arum sold land that belongs to Asisi village to the governor, His Excellency, Governor Peter Mbah, and pocketed the money. The land was sold to the governor for N200 million by the agreement of the whole community, but the man started spending the money, by constructing roads and other things without consulting the community.”

“The community does not have a traditional ruler today, because of the man’s many activities. The Asisi village is in crisis because the man has been selling land that belongs to everybody. He sold the land where we have a boundary with Ndiagu. If it were not for him, we don’t have any reason to be dragging land with our brothers in Ndiagu Owo.”

He added, “The former governor of Enugu State, His Excellency, Ifeanyi Ugwuanyi once called him to leave Owo Town and mind Mburu Owo Autonomous Community, but he refused. The crisis in Ohani, Ogara, and other clans over the sales of community lands is from him.

Advertorial

“We are pleading with Governor Peter Mbah to please deliver us from the hand of this man.

“His Excellency should please save us from the terror of this man so that we can select the person that will be our traditional ruler by ourselves,” he pleaded.

Lamenting the alleged high-handedness of Igwe Arum, the Chairman of Ohani Owo Development Association, Emmanuel Egbo, said that the people of Obeagu Ohani Owo (one of the clans that form the Mburu-Owo Autonomous community) were not happy and were unwilling to continue to be part of the Mbulu Owo Autonomous community.

Egbo said Igwe Arum has never deemed it fit to influence development in the area.

He said the people are equally threatened by his divide-and-rule style of leadership.

“What this man is doing is abominable, he is presently bulldozing people’s farmland, appropriating and selling same.”

“I don’t know what he has in mind because he has some cronies among our people. He locked up the community head and we have been on the case for some time now,” he added.

When contacted on telephone, Igwe Okeke Arum said, he doesn’t talk to anybody on the telephone, adding that anybody who wants to know his side of the story should come to his house to interview him.

“All Eyes On The Judiciary “: Atiku Knocks Tinubu Over Billboards’ Removal

The presidential candidate of the Peoples Democratic Party in the 2023 election, Atiku Abubakar has flayed President Bola Tinubu over the destruction of billboards in strategic locations in the Federal Capital Territory drawing public attention to the judiciary as Nigerians await the verdict of the court in the Presidential Election Petition tribunal.

Speaking through his Special Assistant on Public Communications, Mr Phrank Shaibu, Atiku described the destruction of the billboards which had the inscription, ‘All eyes on the judiciary,’ as a clear evidence of “President Bola Tinubu’s authoritarianism and assault on the freedom of speech.”

Advertorial

In a statement issued on Tuesday in Abuja, Mr Shaibu said the directive by the Advertising Regulatory Council of Nigeria to pull down all billboards carrying the advert across Nigeria was totally uncalled for.

“ARCON also dissolved the Advertising Standard Panel which is the statutory panel under the council charged with the duty of ensuring that advertisements conform to the prevailing laws of the Federation as well as the code of advertising ethics of the advertising profession,” the statement read in part.

According to Shaibu, the whole incident reinforced the argument that “Election cases in court ought to be completed before beneficiaries of questionable elections are inaugurated.

He further wondered how a message like, ‘All Eyes on the Judiciary’ translates to a threat to society.

The statement read, “The basic principle of social justice is about the people. The advertisers of the billboards only did what the norm is in civilized climes. It was the agents working to impress an interest that read meanings to that innocuous advert. Otherwise, it is a basic principle that eyes must be on the wheel of justice. Eyes must naturally be on the wheel of justice because when justice is delivered, it must be ‘seen’ to have been just! In any case, both Tinubu and the APC are before the same court. It is curious how they find this particular message upsetting. Anyway, even if they pull down the billboards, they can never stop all eyes from being on the judiciary at this historic time.”

He further noted that ARCON had already begun acting like the Lagos State Signage and Advertising Agency which he noted “Had built a reputation of denying Nigerians the right to carry adverts which the Lagos State government deemed ‘unfavourable.’

He continued, “Tinubu has, once again, put his dictatorial tendency on public display. How has a simple message that says ‘All eyes are on the judiciary” suddenly become offensive? This is a clear case of abuse of office and reinforces the argument that court cases ought to be concluded before inauguration so that beneficiaries of fraudulent elections would not be able to manipulate the system in their favour.

“Billboards are used in displaying educational messages. Is there any offence in alerting Nigerians to the fact that all eyes should indeed be on the judiciary? In any case, is there any Nigerian that does not know that the judiciary is hearing the case challenging Tinubu’s fraudulent victory? Even the justices themselves are aware that all eyes are on them because of the historic assignment that they are saddled with. If Tinubu had nothing to hide, why would he be afraid of such a message?

“Nigerians can now see what the people of Lagos have been facing all these years where LASAA denies the opposition the use of billboards just to please their master. It has become so bad that Tinubu’s son is the one that has exclusive rights to billboards on the Lekki axis. Who can forget that the company where Tinubu’s son enjoys commanding heights admitted to turning off the billboard lights during the #ENDSARS protests? And the only ridiculous explanation for such a dastardly act is that it wasn’t in bad faith.”

Shaibu said it was ironic that “Tinubu claimed to be a democrat and even boasted of funding the June 12 struggle only for him to transform into an intolerant authoritarian after the election.”

Atiku’s aide further said it was hypocritical for Tinubu to be championing democracy in Niger Republic while simultaneously denying Nigerians the most basic form of democracy which includes freedom of speech and expression, adding that “He needs to be reminded that charity begins at home.”

Shaibu added, “While we keep calling on the judiciary to restore the mandate of the people, we cannot but ask the citizens to be vigilant as the con-man tries to undermine our democracy. Having failed in his last 70 days in office, which has increased Nigeria’s inflation and destroyed the value of the naira, systematically denied Nigerians the right to protest or go on strike; under the watch of this administration, inflation had climbed to an 18-year high.”

“He wants to regulate social media so that his failures would not be amplified. You can’t flog Nigerians, and expect them not to cry. This will never happen.”

Withdraw All Sanctions Against Niger – Northern Elders Urges Tinubu

The Northern Elders Forum (NEF) has advised President Bola Ahmed Tinubu to as a matter of urgency withdraw all sanctions imposed on Niger Republic while dialogue continues.

Daily Gazette reports that Nigeria has closed all its borders with Niger Republic, cut off electricity, among other sanctions.

Advertorial

In a statement in Abuja, Director of Advocacy and Public, Dr. Hakeem Baba Ahmed, advised that “Nigeria should remove all sanctions and other measures intended to force the government and people of Niger into acquiescence. This will make negotiations led by Nigeria, using all assets that both countries value, easier to conduct”.

Speaking, further, NEF advised President Tinubu to ensure “The safety of President Bazoum and his family and restoration of the constitutional order must remain non-negotiable priorities. The military leaders in Niger must accord due cognizance and respect for the position of ECOWAS, whose fundamental principles and goals Niger Republic submitted to.

“Also President Tinubu should explore ways of balancing these responsibilities without doing any injury to the position of Nigeria and Nigerians on Niger Republic and the unity of the ECOWAS,” Baba-Ahmed said

The Forum also dismissed the use of force in the troubled country, adding that the move will further compound the issue.

“The use of force against Niger should be ruled out. It is unlikely to achieve the goals of restoring the constitutional order and improving the frontiers of democratic systems in West Africa. It will compound the security and humanitarian crises in the ECOWAS region.

“It is likely to weaken and further divide the ECOWAS and provide greater access of non-African interests into the lives of Africans, with negative consequences,” he added.

Court Restrains DSS From Arresting Emefiele’s Siblings

The Federal Capital Territory (FCT) High Court has restrained the Department of State Services (DSS) from arresting two siblings of the suspended Governor of the Central Bank of Nigeria (CBN), Godwin Emefiele.

Justice E. Okpe, who is the court’s vacation judge, issued the restraining orders in two rulings on separate ex-parte motions filed by the suspended CBN governor’s siblings – George Emefiele and Okanta Emefiele.

Advertorial

In his ruling on the ex-parte motions, Justice Okpe held that the restraining order shall subsist pending the determination of the fundamental rights enforcement suits filed by George and Okanta.

“An order of interim injunction, restraining the 1st respondent whether by themselves, their officers, agents, servants, privies or acting through any person or persons however from threatening, harassing, intimidating, inviting and arresting the applicant or in any other manner whatsoever, interfering with his rights to life, freedom of movement, personal liberty, and human dignity until the determination of the substantive suit,” The Nation quoted Justice Okpe as saying in one of the rulings.

After the rulings on August 4, the judge adjourned till August 14 for hearing on the substantive suits, marked FCT/HC/CV/7050/2023 and FCT/HC/CV/7051/2023, with the DSS and the Attorney General of the Federation (AGF) listed as respondents in both suits.

At the resumed hearing of the suits on Monday, Justice Okpe noted that the DSS was yet to respond to the substantive and proceeded to reschedule the hearing for August 23.

However, the AGF in a counter affidavit faulted the claims by George and Okanta and denied knowledge of any plot to arrest any of them.

Meanwhile, in an affidavit supporting the suit by George, it was stated that “as siblings, the applicant periodically visits his brother Mr. Godwin Emefiele in the custody of the 1st respondent (SSS) whenever access is granted to him or any other family member”.

It added, “Because of the applicant’s relationship with Mr. Godwin Emefiele, he reasonably believes that the 1st respondent is taking steps to infringe on his fundamental human right and that of other family members by arresting and detaining the applicant.

“The applicant has not committed any offence that will warrant any invitation to the office of the 1st respondent or detention by the 1st respondent.

“The applicant knows for a fact that it is not a crime to be associated with a suspect, who is under investigation or being investigated by the 1st respondent.

“The applicant reasonably believes that his fundamental human right is about to be infringed by the respondents in respect of the purported ongoing investigation of Mr. Godwin Emefiele.

”They want the court to, among others, issue an order of perpetual injunction restraining the SSS from inviting, intimidating, harassing, and arresting or detaining them in relation “to matters or body of matters which relates to the ongoing investigation of Mr. Godwin Emefiele and/or matters outside the constitutional and statutory mandate of the 1st respondent.”

But the office of the AGF in a counter affidavit, faulted Okanta’s claim to be Emefiele’s relative and pleaded with the court to dismiss both suits for lacking in merit, adding that the 2nd respondent (the AGF) is not aware of the alleged relationship between the applicant and the suspended CBN governor, and that no evidence of such association or relationship is before the court.

The counter affidavit stated: “The applicant did not place anything before the court to show that he was about to be invited or arrested by the 1st respondent, who neither arrested nor detained him for over two months that he has been visiting his brother in the custody of the 1st respondent.

“The applicant did not state any overt or positive act(s), specific step, or action taken by the 1st respondent which will inevitably and eventually lead to the violation of his fundamental rights.

“The respondents are not seeking to arrest the applicant in lieu of his brother. The 1st respondent has not stated that the applicant is being or about to be invited or arrested for financial, commercial or contract-related matters.

“It is not the place of the applicant to determine whether he has committed any offence that will warrant the invitation or not, neither can he dictate to the 1st respondent when and how to invite him in connection with the ongoing investigation of his brother or for any reason whatsoever.”
