‘Go To Court’ – Legal Practitioners Committe Rejects Afe Babalola’s Request To Revoke Farotimi’s License

The Legal Practitioners Disciplinary Committee (LPDC) has dismissed a petition from the law firm of Chief Afe Babalola (SAN), Emmanuel Chambers, seeking to revoke the law license of lawyer and author Tomilola Farotimi, also known as Dele Farotimi, over allegations of criminal defamation and professional misconduct.

Farotimi, who was brought before the LPDC following a complaint filed by Ola Faro, a lawyer at Emmanuel Chambers, faced allegations related to his book Nigeria and the Criminal Justice System.

The petition claimed the book contained defamatory remarks about the Supreme Court and the legal profession.

However, the LPDC concluded that the alleged offenses occurred while Farotimi was acting as an author, not as a practicing lawyer.

The committee stated it did not have jurisdiction over the complaint, as the matter pertained to the content of a publication rather than any actions taken during his legal practice.

LPDC Chairman, Justice Isaq Usman Bello, affirmed that the committee’s jurisdiction did not extend to matters concerning written publications and advised the petitioners to seek redress through the appropriate regular courts.

The book in question allegedly criticized a Supreme Court case involving corruption and unethical conduct among judicial officers, while also addressing what Farotimi described as distortion of case facts and the undermining of justice.

Emmanuel Chambers accused Farotimi of disrespecting his peers and engaging in actions for personal gain, claiming his book violated the 2023 Rules of Professional Conduct for Legal Practitioners.

They called for Farotimi’s removal from the Roll of Legal Practitioners.

In response, the LPDC clarified that the book was an intellectual work and not an action taken during Farotimi’s practice as a lawyer.

The committee urged those who felt defamed by the publication to pursue their grievances in the regular courts.

Just In: Dele Farotimi Released From Ekiti Prison After Perfecting Bail

Human rights lawyer Dele Farotimi has been released from the Ado-Ekiti custodial center, where he had been detained for weeks over an alleged defamation case.

Farotimi’s release on Tuesday morning follows his successful completion of the bail process.

The lawyer had been arrested following a defamation claim made by Chief Afe Babalola (SAN).

Despite being granted bail on multiple occasions, Farotimi remained incarcerated until now.

Farotimi was granted bail on December 9, 2024, by Justice Babs O. Kuewumi of the Federal High Court in Ado-Ekiti, in connection with cybercrime charges filed by the Nigeria Police.

However, his release had been delayed by bureaucratic challenges involving the verification of surety documents from banks and government agencies.

The verification process was completed last Friday, but further delays were caused as the judge had not yet signed off on the required documents, preventing the prison authorities from releasing him.

In addition, the Ekiti Magistrate Court, which also granted bail on December 20, 2024, had not completed all necessary formalities before the presiding magistrate, Abayomi Adeosun, departed the court, further postponing Farotimi’s release.

Farotimi is facing charges in two courts related to an alleged defamation of Afe Babalola.

The Federal High Court granted him bail of N50 million, with one surety, on the cybercrime charges.

This decision came after the Inspector-General of Police filed a 12-count charge against him.

The magistrate court in Ekiti granted a separate bail of N30 million on December 20, 2024, with two sureties required, and Farotimi was also instructed to surrender his passport.

Furthermore, he was barred from granting media interviews.

Thugs Invade Edo LG Secretariat, Block Chairman From Entering Office

Suspected political thugs on Monday seized control of the Oredo Local Government Area (LGA) secretariat in Edo State, preventing Chairman Tom Obaseki from accessing his office.

The armed hoodlums positioned themselves strategically around the secretariat and chanted war songs, creating a tense atmosphere.

This forced Obaseki, who had arrived to resume his duties for the day, to retreat and address the situation from outside the council premises.

Speaking to journalists, Obaseki expressed his frustration, saying, “I came to continue my work as the elected chairman of Oredo Local Government, but I found the secretariat overtaken by thugs. This is a very troubling situation, and we are calling on the security agencies to intervene and restore order.”

He also emphasized the existence of a restraining order in his favor.

Obaseki’s return to work followed a ruling by the Edo State High Court last Friday, which overturned his suspension along with 17 other council chairmen.

The suspensions had been imposed by the Edo State House of Assembly after Governor Monday Okpebholo filed a petition accusing the council heads of insubordination and misconduct.

Russian Court Sentences American Citizen To 15 Years For Espionage

A Russian court has sentenced American citizen Gene Spector to 15 years in a penal colony on charges of espionage, according to Russian news agencies.

The court’s decision was reported on Tuesday.

Over recent years, Russia has detained and convicted several US citizens and dual nationals on espionage charges, some of whom have been released in prisoner swaps.

Wall Street Journal reporter Evan Gershkovich was sentenced for espionage in July but was released in August.

Moscow City Court handed down the sentence to Spector, who will serve the 15 years in a strict-regime penal colony.

The sentence also takes into account a prior conviction he received for bribery.

RIA Novosti published a photograph of Spector in the courtroom, seated in a defendant’s cage, wearing glasses and a dark jacket.

Details regarding the espionage allegations against Spector have not been made public.

The trial, apart from the sentencing, was conducted behind closed doors due to the classified nature of the case.

Spector, born Yevgeny Mironovich in 1972 in Leningrad (now Saint Petersburg), is a US citizen who had previously lived in Russia. He is married and has children.

He was arrested in 2020 and, in 2021, was sentenced to four years in prison for his role as an intermediary in a bribery case involving luxury holidays for an aide to former Deputy Prime Minister Arkady Dvorkovich.

After a retrial, his sentence was reduced by six months.

TASS news agency reports that Spector, originally from Russia, later moved to the US where he became a citizen.

He was previously the general director of the Medpolimerprom company group in Russia.
