Bianca Finally Wins Long-drawn Legal Battle Over Ojukwu’s Property

A Lagos High Court sitting in Ikeja has delivered judgment in the long-drawn litigation over the management and control of some of the assets of Ojukwu Transport Ltd, OTL, in favour of Ambassador Bianca Ojukwu, widow of the late Igbo leader, Dim Chukwuemeka Odumegwu Ojukwu, and her two children.

The late Ikemba Nnewi was a director of OTL, a family company, before he died in 2011.

The suit, LD/1539/2012, filed by Bianca on behalf of the claimants, her two sons, Afamefuna and Nwachukwu, who were infants at the time, against OTL and seven others (brothers of the late Dim Ojukwu, their sons and property agent) before the court, was over alleged move by the defendants to take possession of claimants residence at No. 29 Oyinkan Abayomi Drive, Ikoyi, Lagos, as well as some of the company’s property in Lagos, which were under the management and control of their late Biafran warlord.

The defendants in the suit filed in 2012 are OTL, Prof. Joseph Ojukwu, Engr. Emmanuel Ojukwu, Lotanna Putalora Ojukwu, Dr. Patrick Ike Ojukwu, Arch. Edward Ojukwu, Lota Akajiora Ojukwu and Messrs. Massey Udegbe (doing business under Massey Udegbe & Company).

The claimants stated that at about August 4, 2011, while their father was sick and hospitalized in London, the 4th-7th defendants attempted to forcibly take possession of their home at No. 29 Oyinkan Abayomi Drive (formerly Oueens Drive), Ikoyi, Lagos, claiming that after the death of their father and soon after his burial, the 2nd-7th defendants went on to appoint a property agent, the 8th defendant, to take over, not only their father’s residence at Oyinkan Abayomi Drive but also other property under the possession, management and control of their father, namely No. 13 Hawksworth Rd (now known as 13 Ojora Rd) Ikoyi; No. 32A Commercial Ave, Yaba, Lagos; No. 30 Gerard Rd, Ikoyi, Lagos and No.4 Macpherson Avenue, Ikoyi, Lagos.

Delivering judgment on June 24, this year, the court presided over by Justice A. M. Lawal, after considering all the evidence adduced by the parties in the course of the proceedings spanning about 10 years, ruled that the claimants being biological children of the late Dim Chukwuemeka Odumegwu Ojukwu by that virtue are entitled to the estate of their father, as well as his entitlements as a deceased director and shareholder of the Ist defendant.

Justice Lawal stated that “equity is fairness and fairness is equity,” adding that as a court of equity, the court would not allow the dispossession of the claimants who are children of a foundation director of the company while other directors are in hold and control of other property of the Ist defendant and deriving benefits from the same.

“Therefore, the claimants are entitled to possess and control what their late father possessed and controlled in the company, OTL, when he was alive,” he ruled.

The judge stated that the fact that the 1st defendant allowed the family of the company to live on, and derive income from the assets of the company all these years was a decision of the company by conduct.

He noted that the 2nd defendant who had refused to surrender the property under his control for joint management cannot now lead the battle of having the deceased director’s children hounded out of possession of the property that was managed by their late father.

The counterclaim instituted by the defendants was struck out for lack of competence as the court declared “That the claimants are entitled to the possession and occupation of the property known as No. 29 Oyinkan Abayomi Drive (formerly Oueens Drive), Ikoyi, Lagos, until the harmonization of the management of the assets of the Ist defendant;

“That the threat of forceful ejection of the claimants from No.29 Oyinkan Abayomi Drive, Ikoyi, Lagos, by the defendants is illegal;

“That the claimants are also entitled to the possession of the properties known as No 13 Hawkesworth Rd, Ikoyi (now known as No 13 Ojora Rd, Ikoyi); No. 32A Commercial Avenue, Yaba, Lagos; No. 30 Gerard Rd, Ikoyi, Lagos and No. 4 Macpherson Ave, Ikoyi, Lagos, which were some of the properties that were under the possession of the late father of the claimants from the time the properties were released from government acquisition.

“That the 2nd-8th defendants are restrained either by themselves or through their agent or privies from interfering with the claimants’ possession and control of the 5 listed properties, being the subject matter of the suit.”

Morocco Beat South Korea For First Women’s World Cup Win

Morocco won a Women’s World Cup match for the first time after Ibtissam Jraidi struck early to give them a stunning 1-0 victory over South Korea on Sunday.

Coup: We Will Not Recognise New Authorities In Niger – EU Thunders

The European Union (EU) has said it does not and will not recognize the authorities resulting from the putsch in Niger.

The EU made its position known in a statement by Nabila Massrali, spokesperson for Foreign Affairs and Security Policy, in a statement on Saturday.

“President Bazoum was democratically elected; he is and therefore remains the only legitimate President of Niger.

“His release must be unconditional and without delay. The EU holds the putschists responsible for his safety and that of his family,” it stated.

It said the announcement by the putschists of the suspension of the constitution and the dissolution of democratic institutions weakens the State and the people of Niger, whose peace, stability and security must be preserved.

The EU reiterated its very clear calls for the full and complete restoration, without delay, of constitutional order and fully associates itself with the declarations of ECOWAS and its African and international partners in this regard.

“In coordination with the President of the European Council, I will continue this weekend the numerous contacts already underway in order to achieve this result. And we stand ready to support future ECOWAS decisions, including the adoption of sanctions.

“This unacceptable attack on the integrity of Niger’s republican institutions will not remain without consequences for the partnership and cooperation which binds the European Union and Niger, in all different aspects.

“In this regard, in addition to the immediate cessation of budget support, all cooperation actions in the security field are suspended sine die with immediate effect,” said High Representative Josep Borrell.

The youths reportedly started the looting spree at the grain warehouse located at PZ Roundabout, a stone’s throw away from the Yola International Airport.

In what appears as a repeat of the fallout of the #EndSARS protest of 2020, youths in Adamawa are currently looting government-owned grain reserves and other shops.

One of the looters who spoke to our correspondent blamed the action on the hardship being experienced in the country following the removal of subsidy on premium motor spirit otherwise known as petrol.

To manage the situation, Governor Ahmadu Umaru Fintiri has declared a 24-hour curfew.

A statement from the Chief Press Secretary to the governor, Himwashi Wonosikou said, “The Governor of Adamawa State, the Rt Hon Ahmadu Umaru Fintiri has declared a 24-hour curfew on the state, effective immediately Sunday, 30th July, 2023.

“Governor Fintiri said the curfew followed the dangerous dimension the activities of hoodlums had assumed across the state capital as they attack people with machetes and break into business premises and homes, carting away property.

“With the curfew imposed, there will be no movement throughout the state.

“Rt. Hon. Fintiri said only those on essential duties with valid identification would be permitted to move around during the period of the curfew.

“The Governor is appealing to citizens and residents of the state to comply with the directive, adding that any person found contravening the order would be arrested and made to face the wrath of the law.”

Gov. Otti Takes Construction Of Roads To Rural Areas

Governor Alex Otti of Abia State has kicked off the handing over of road projects to different contractors in a manner described by the residents of the city as novel.

The process of rejuvenating Aba, the commercial nerve centre of Abia State, kicked off with the hand over of nine road works to different contractors by Governor Otti.

The governor who was accompanied by his Special Adviser on Works, Engineer Otumchere Oti, defied the afternoon showers as he toured the degenerated roads across the Aba metropolis.

Excited residents cheered the governor and his entourage, which included the Speaker of the State House of Assembly, Rt Hon Emmanuel Emeruwa; his deputy, Rt Hon Augustine Meregini and the deputy Majority Leader, Hon Destiny Nwagwu, at every stop as he (Otti) was shocked by the level of the decadence of some roads that dotted the long stretches of the roads earmarked for rehabilitation.

Angered by what he saw, the Abia governor declared, “We had promised that we’re going to rebuild the roads. The first thing is that we clear the drainages, because if we don’t do that, we won’t be able to build roads that would last.

“As you can see on this Azikiwe Road, the main job here is to clear the drainages, desilt them and open up the flow of water to Aba River.

“There are a few roads we want to rebuild completely and those are the roads that we have come to handover to the contractors today”.

The roads will receive immediate attention in order to significantly reduce the sufferings of motorists within Aba area.

Minister Designates: ‘No More Bow And Go’ – Senators Disagree On Mode Of Screening

Ahead of tomorrow’s commencement of the screening of the 28 ministerial nominees, senators have disagreed sharply on the screening processes.

While the Senate Majority Leader, Opeyemi Bamidele and Chairman, Senate Committee on Media and Public Affairs, Yemi Adaramodu, are saying that the screening of the nominees would be thorough as there would be “no take a bow and go” as was obtainable in the past, the former Senate Minority Leader, Enyinnaya Abaribe, disagreed, saying that nothing new would happen.

Abaribe said: “The screening of the ministerial nominees will not be different. Nothing has changed to give any signal of a change in methodology.”

Another Senator who spoke on the condition of anonymity, agreed with Abaribe, saying that with the composition in the first place where former governors, former senators and ex-members of the House of Representatives are dominating the list, it would be more of a ‘take a bow and go’ show.

Recall that the President of the Senate, Senator Godswill Akpabio had on Thursday read out the 28 ministerial nominees sent by President Bola Tinubu for screening.

Following the unveiling of the nominees, Adaramodu, while addressing Journalists on Thursday boasted that the senators would be thorough during the screening as they would dwell on experience, character, personality, and background, among others, just as there will be no take a bow and go except when there are no questions.

On the usual take a bow which has become a norm for former senators, the Senate Spokesperson said: “It is a norm and not an anathema. Even if you came to National Assembly to submit a paper, you must take a bow. So the issue of taking a bow is not an anathema, it is a tradition and not a slang for complacency. It does not mean you cannot be held accountable. It is just a norm.”

Corroborating Adaramodu, Bamidele reiterated that the Senate would be thorough with the screening to ascertain their competencies and capabilities to serve Nigeria.

“Let me assure Nigerians that there won’t be any bow and go during the screening except for those who had been members of the National Assembly and whom we knew have the wherewithal to give Nigerians qualitative leadership.”

Sit-at-home: Hope Uzodimma Fumes, Ask FG, Military To Extradite Ekpa To Nigeria 

Governor Hope Uzodimma of Imo state has reiterated the need to restore peace and end insurgency in the southeast.

The governor also called for the extradition of Finland-based separatist Simon Ekpa over the illegal Monday sit-at-home order.

He appealed to the Federal Government to collaborate with the Finnish Government to extradite Ekpa to Nigeria for prosecution.

He disclosed this during a familiarisation visit from the new General Officer Commanding GOC, 82 Division, Enugu, Major General Hassan Dada, at the Government House in Owerri, the Imo state capital.

He said:
“What is topmost in our cases is this popular sit-at-home order. There’s one man called Simon Ekpa somewhere in Finland.

“It is our hope that the security agencies, particularly the military, working with the Federal Government, will be able to either bring Simon Ekpa back to Nigeria to also sit at home with us or be made to face the wrath of the law.”

He also spoke on the negative effect of the illegal sit-at-home orders, promising the new GOC and his team his support and that of the people of Imo state.

2 Fire Incidents In 48 Hours Ravage Properties Worth Millions Of Naira

A shopping complex of 20 shops located in Ilorin, Kwara State, has been gutted by fire, destroying properties worth millions of naira.

The incident, which occurred on Saturday around 6 am, affected a shop with N3.2million worth of people destroyed at Fufu Street, Sabo-Oke area in Ilorin East Local Government.

This is the second fire incident in the state within two days after a Thursday inferno that destroyed a four-bedroom flat and 10 shops in Offa Local Government Area.

A total of N42.8m was destroyed in both incidents, which resulted from a power surge, according to the spokesman of the Kwara State Fire Service, Hassan Adekunle on Saturday.

He said the director of the service, Prince Falade John Olumuyiwa, urged the citizens to always cultivate the habit of switching off their electrical appliances even before bedtime.

He added that such a move would help to prevent the chances of fire outbreaks in homes, offices and shops.
