Court Sacks All NNPP Candidates For Kano LG Elections, Orders New List

A Federal High Court in Kano has disqualified all 44 New Nigeria Peoples Party (NNPP) chairmanship and councillorship candidates from participating in the local government elections on Saturday.

The decision was handed down on Friday by Justice Simon Amobeda in response to a lawsuit filed by Engineer Muhammad Babayo and a faction within the NNPP challenging the party’s leadership.

Advertorial

Justice Amobeda directed the Kano State Independent Electoral Commission (KANSIEC) to accept a revised list of candidates submitted by the faction led by Dalhatu Shehu Usman, the party’s recognized State Chairman, as specified in the NNPP’s constitution.

In his ruling, Justice Amobeda declared: “The defendant is hereby restrained from releasing the voters register for the 2nd Defendant to conduct the proposed election on 26th October 2024.”

He further instructed KANSIEC to acknowledge the candidates submitted by the plaintiffs as the legitimate contenders.

The case also named the Independent National Electoral Commission (INEC), KANSIEC, the Inspector General of Police, and the Director of the Department of State Services (DSS) as defendants.

Justice Amobeda ordered that the second defendant, KANSIEC, should treat the list submitted by Usman’s faction as the “genuine and subsisting” list for the 2024 election, stating, “The 2nd Defendant is hereby directed to accept as genuine and subsisting the list of NNPP candidates submitted to it by the recognized State Chairman, Dalhatu Shehu Usman,” while directing that “any other list submitted for the 2024 Local Government Election in Kano State should be rejected.”

Advertorial

Additionally, the court restrained the Inspector General of Police and the DSS from providing security if the elections proceed without the corrected candidate list.

Justice Amobeda ruled, “That the 3rd and 4th Defendants are forthwith restrained from providing security and protection to the scene of the Election plans to take place on the 26th October, 2024.”

JOHESU Declares Seven Day Warning Strike

Members of the Joint Health Sector Unions and Assembly of Health Care Professionals (JOHESU) have initiated a seven-day warning strike starting from midnight on Friday.

This action follows what the union describes as the Federal Government’s failure to address key welfare concerns.

Advertorial

The decision to strike was announced by JOHESU’s National President, Kabiru Minjibir, during a press briefing in Abuja on Friday, shortly after the union’s national executive council meeting.

Minjibir stated that despite numerous assurances from the government during discussions with various ministries and agencies, there had been no concrete progress.

Minjibir emphasized that the strike might have been avoided if the government had responded to the union’s 15-day notice, which was issued earlier this month.

Advertorial

He highlighted the core demands, including the enforcement of the consolidated health salary structure and a 25 percent review of arrears from June to December 2023.

Additionally, the union is seeking an increase in the retirement age for health workers, tax exemptions on allowances, and the prompt disbursement of COVID-19 hazard allowances.

He said: “In compliance with the Provisions of Section 41 of the Trade Disputes Act Cap. T8 Laws of the Federation of Nigeria, 2004, members of JOHESU affiliate unions from Medical and Health Workers’ Union of Nigeria (MHWUN), Nigerian Union of Allied Health Professionals (NUAHP), Senior Staff Association of Universities, Teaching Hospitals, Research Institutes and Associated Institutions (SSAUTHRIAI), and Non-Academic Staff Union of Educational and Associated Institutions (NASU) will begin a seven-day strike action from midnight on 25th October 2024 in Federal Health Institutions.”

Advertorial

He urged the public to be patient with any disruptions caused by the strike: “The general public should bear with us all inconveniences the withdrawal of services of health workers under the umbrella of JOHESU might cause during this period.”

Minjibir called for public support, emphasizing the goal of improving healthcare: “We urge the consumers of health care and well-meaning Nigerians to empathise with us and also give solidarity to this struggle which is aimed at making healthcare delivery effective, accessible and affordable in the country.”

Advertorial

He further expressed the union’s frustration over the government’s inaction: “JOHESU has always exhibited maturity, selflessness and patriotism even in the face of extreme provocations and government’s long delay in meeting our demands and we think that our maturity and patriotism have been taken for granted.”

Minjibir affirmed JOHESU’s dedication to resolving the issues through dialogue and warned against any punitive measures against those participating in the strike, which he termed a “dispute of right.”

Court Clears University Lecturer of Alleged Rape

A lecturer from the University of Benin (UNIBEN), Dr. Bode Ekundayo, has been acquitted of rape charges by the Edo State High Court in Benin, presided over by Justice Mary Itsueli.

The court’s decision comes three years after the initial allegations were made.

Advertorial

Dr. Ekundayo, an Associate Professor in the Department of English and Literature, was accused of demanding sexual favors in exchange for grades from a 21-year-old 400-level student, Miss Anita Adesuwa Efosa, on October 5, 2021.

The alleged incident was said to have occurred in his office at UNIBEN’s Faculty Complex during the day.

Following the allegations, the university placed Ekundayo under an inquiry and suspended him pending the results of a police investigation and court proceedings.

Advertorial

He was detained for several weeks before being released on bail with stringent conditions.

However, after a lengthy legal battle, the court has now discharged him due to insufficient evidence.

In case number B/CD/8CV/22, Justice Itsueli emphasized that the prosecution failed to establish a solid case against Dr. Ekundayo.

Advertorial

Even if the allegations by the victim were accepted at face value, she noted, there was no concrete proof of sexual intercourse or rape.

The judge upheld a no-case submission filed by Ekundayo’s defense lawyer, Dr. Osagie Obayuwana, a former Attorney-General and Commissioner for Justice in Edo State.

Justice Itsueli highlighted the absence of crucial evidence, such as the medical report from UNIBEN’s Health Centre, which the prosecution did not present during the trial.

Advertorial

The report from Vivian Medical Centre, where the alleged victim underwent testing the day after the incident, also failed to confirm any signs of rape.

A medical doctor from Vivian Medical Centre testified that it would be challenging to confirm sexual intercourse or rape 24 hours after the event, basing his conclusions on the alleged victim’s statements rather than concrete evidence.

Justice Itsueli also pointed to the lack of physical evidence, such as bruises or torn clothing, from the police investigation, which included an examination of both the accused and the alleged victim, as well as an inspection of the lecturer’s office.

Advertorial

Given these findings, the judge dismissed the charges, ruling that the prosecution failed to prove the essential elements of rape, including penetration, sexual intercourse, and lack of consent.

Justice Itsueli concluded that the case appeared to be a setup and ruled in favor of Dr. Ekundayo, closing the case for lack of substantial evidence.

Policemen Beat, Detain NSCDC Officer

There has been widespread outrage over the reported beating and detention of a Nigeria Security and Civil Defence Corps (NSCDC) officer by policemen in Osun State.

The incident occurred after the NSCDC officer reportedly stopped the policemen from entering an estate without an arrest warrant or proper identification.

Advertorial

According to The Nation, the policemen, dressed in plain clothes, attempted to access Elizabeth Estate through the Osun State Secretariat on Wednesday for an arrest.

However, the on-duty NSCDC officer blocked their entry due to concerns over their identities.

A source within the estate explained: “Policemen from Ataoja came to our estate for arrest without warrant and the NSCDC urged them to provide one, else he won’t allow them in. It resulted to altercation where 20 police reinforced to the scene and they beat him up and injured two residents brutally.”

Advertorial

In response, Kehinde Adeleke, spokesperson for the Osun NSCDC, criticized the actions of the police.

She confirmed the arrest of the NSCDC officer, noting that his uniform was torn and that he was handcuffed, arrested, and detained at the Ataoja Police Command.

The Osun Police spokesperson, Yemisi Opalola, acknowledged the incident, stating, “the NSCDC officer beat up two of our men and deflated the tyres of their vehicle.”

Advertorial

However, Comrade Waheed Saka, the convener of Dialogue 365, condemned the actions of the police, labeling them as “barbaric.”

He added, “There are rising cases of police brutality in Osun State lately. The recent extrajudicial activities of police may result to another massive protest against police.”

Court Reserves Judgment In Suit Seeking To Stop Rivers Fund Allocation

Justice Joyce Abdulmalik of the Federal High Court in Abuja has reserved judgment on a case brought by the Rivers State House of Assembly and its Speaker, Martin Amaewhule, seeking to halt the allocation of funds to the Rivers State government.

After hearing all arguments related to the main suit, as well as motions and objections, the judge indicated that a decision would be delivered at a later date, which will be communicated to all involved parties.

Advertorial

The plaintiffs, in case number FHC/ABJ/CS/984/2024, have named several defendants including the Central Bank of Nigeria, Zenith Bank, Access Bank, the Accountant General of the Federation, Rivers State Governor Siminalayi Fubara, the Rivers State Accountant General, the state’s Independent Electoral Commission, and other officials.

They are seeking a court order to freeze funds allocated to Rivers State.

Earlier, Justice Abdulmalik dismissed a request by the Rivers State government and other defendants to pause the proceedings while an appeal is pending.

Advertorial

The judge described the request as “frivolous, vexatious, unwarranted, and mischievous.” Furthermore, a motion from the Rivers State Accountant General, asking the judge to withdraw from the case due to alleged bias, was rejected.

Justice Abdulmalik emphasized that her conduct was impartial, refusing both the recusal and a request to move the case to the Federal High Court in Port Harcourt.

She underscored that the Federal High Court’s jurisdiction covers the entire country and that case assignments fall under the Chief Judge’s discretion.

Advertorial

The legal conflict traces back to July 15, when the Rivers Assembly, led by Martin Amaewhule, suspended Governor Fubara’s expenditures until he resubmitted his budget for approval.

The Assembly set a seven-day deadline for the governor, which subsequently expired without a submission.

In response, the Assembly froze the state’s Consolidated Revenue Account, restricting financial activities by Fubara’s administration.

Advertorial

The plaintiffs’ motion seeks to prevent the Central Bank, Zenith Bank, Access Bank, and the Accountant General of the Federation from processing any financial instructions issued by Governor Fubara, thereby freezing the state’s funds.
