Undeterred Advocates Push For New States Despite Constitutional Challenges

Despite significant constitutional challenges, advocates for the creation of new states in Nigeria are undeterred, leading to a surge in demands and bills in the National Assembly.

Nigeria’s history of state creation dates back to 1967 when Gen. Yakubu Gowon created 12 states from the existing four regions.

Successive military rulers further increased the number of states to 36 by 1996.

However, no new states have been created under civilian rule since 1999, largely due to the stringent requirements of the 1999 Constitution.

Section 8(1) of the Constitution outlines a complex process for creating new states, involving a series of approvals and referendums.

Despite these hurdles, there are at least nine requests for state creation in the National Assembly.

Notable among them is a bill for the creation of Etiti State, which has passed the second reading in the House of Representatives.

Other proposed states include Okura from Kogi State, Orlu from Imo State, Oke-Ogun from Oyo State, and three states in the South West proposed by Hon. Oluwole Oke.

In the Senate, bills for the creation of Adada State from Enugu State and Anioma State from Delta State have passed the first reading.

The push for state creation is also supported by socio-cultural groups like Ohanaeze Ndigbo Worldwide, which has threatened legal action for the creation of an additional state in the South East.

However, experts and civil society leaders question the economic viability of new states. Dr. Vincent Terna Tavershima from Federal University Gombe and Samson Itodo of Yiaga Africa argue for focusing on true federalism and making existing states more functional before creating new ones.

They emphasize the need for regions like the South East to achieve parity with others in terms of state numbers but stress the importance of economic sustainability.

In the South East, the proposed creation of Adada State from Enugu State enjoys significant support.

Promoters highlight its historical, cultural, and widespread acceptance.

The bill for Adada State has passed the first reading in the Senate, and its advocates argue it is the most qualified for creation based on past recommendations and the need for equity and fairness.

Court Orders Nigerian Army To Pay N800 Million For Killing BIRS Official

A Benue State High Court in Makurdi has ordered the Nigerian Army and 10 others to pay N800 million in damages for the wrongful death of Sixtus Terfa Akure, a Senior Inspector of Taxes with the Benue State Board of Internal Revenue Service (BIRS).

Akure was abducted by members of the Nigerian Army on January 15, 2022, and later found dead by the roadside near Aper Aku Estate in North Bank, Makurdi.

A Coroner’s Inquest conducted on March 19, 2022, held the Nigerian Army responsible for his death.

The lawsuit, filed by Desmond Tor Wendeh on behalf of Akure’s family, named the Nigerian Army, the Nigerian Army Council, the Chief of Army Staff, the Chief of Defence Staff, the Commanding Officer of 72 Special Forces, the then Adjutant Captain Osita Obe, and five soldiers as defendants.

Justice Theresa Shija dismissed the defendants’ preliminary objection and ruled in favor of Akure’s widow, Catherine Akure.

The court ordered the Nigerian Army and all named respondents to pay N800 million for violating Mr. Akure’s right to life.

Additionally, the court directed the BIRS to provide Mrs. Akure with a permanent and pensionable position.

‘They Are Playing With Fire’, Ugandan President Warns Anti-Corruption Protesters Of Severe Consequences

Ugandan President Yoweri Museveni has issued a stern warning to anti-corruption protesters planning a banned march in Kampala on Tuesday, stating they are “playing with fire.”

In a televised address on Saturday, Museveni, who has ruled Uganda since 1986, condemned the planned demonstration, labeling it illegal and accusing the protesters of being influenced by foreign interests.

He did not provide further details on these allegations.

“Some elements have been planning illegal demonstrations and riots,” Museveni stated.

Earlier on Saturday, Ugandan police had informed the protest organizers that the planned march would not be permitted, citing intelligence reports suggesting that certain groups intended to exploit the demonstration to incite chaos.

“Demonstrations can only be allowed under our mandate as long as they do not cause public disorder or disrupt the lives of lawful citizens,” said Frank Mwesigwa, the Ugandan police operations director, in a statement to AFP.

Louez Aloikin Opolose, a prominent protest leader, emphasized that they do not need police permission for a peaceful demonstration, asserting it as their constitutional right.

1. The NBA personalized adhesive Stamp, approved by the National Executive Committee of the NBA pursuant to Rule 10(1) of the Rules of Professional Conduct for Legal Practitioners, for mandatory use on all legal documents.
2. E-voting, Universal Suffrage and Uniform Bye-Laws for Branches, Sections and Fora in the NBA Constitution;
3. Introduction of a Uniform NBA Identity Card (Bar Card) which functions as a payment card for ATM, POS and Online Transactions and also entitle lawyers to a variety of discounts and other packages negotiated by the NBA;
4. Automatic Insurance cover for all lawyers who have paid their Bar Practicing Fees;
5. Reduction of the Fees for our Annual General Conference;
6. NBA Partner Discounts with Corporate Partners who offer lawyers discounts on their goods and services;
7. Completed of the development of the new NBA House, at the Central Business District Abuja.
8. Matters for debate at NEC to be by Written Proposals/Counter Proposals submitted and circulated to all NEC members.

DISCUSION AND OR PRESENTATION OF PAPERS AT CONFERENCES
Afam has been a paper presenter and or discussant at the NBA Annual General Conferences in Calabar, Owerri, Port Harcourt, Abuja since 2011. He has also presented a paper to the Young Lawyers Forum at the YLF National Summit in Abuja, Benin and Uyo in 2014, 2015 and 2016 respectively. He has also presented and or discussed papers during the Law week of many branches.

In 2015, Afam presented a paper at the session of the IBA Bar Issues Commission during the IBA Conference in Vienna. His paper titled ‘Legal ethics involved in the fight for the self-regulation of the legal profession in Nigeria with regard to the provisions of the Money Laundering (Prohibition) Act 2011’ was delivered at the session which focused on ‘Dealing dealt with conflicts in a global practice – challenges for the 21st century involving legal ethics and general morality’.

Afam provides pro bono legal representations to indigent persons undergoing criminal trial, incarceration or whose rights have been, are likely to be violated or threatened to be violated.
He has also served as Secretary and Deputy Legal Adviser of his Town Union.
Afam was a prosecutor at the Legal Practitioners’ Disciplinary Committee of the Body of Benchers from 2012 -2014. He was elected the General Secretary of the Nigerian Bar Association in 2014.

Mazi Afam Osigwe, SAN, has emerged victorious in the Nigerian Bar Association (NBA) election, Daily Gazette reports.

Flood Sweeps Away Four In Anambra State

Four individuals are feared missing after being swept away by floodwaters in Nnewi North Local Government Area, Anambra State, following heavy rains that began late Thursday.

The torrential downpour continued through Friday and Saturday, causing severe flooding in the industrial community.

Among the missing are a mother and her child, who were reportedly caught in the floodwaters while returning from a church service.

Minimum Wage: N70,000 Can Only Buy A Bag Of Rice, Ndume Urges Further Review

Former Senate Chief Whip, Ali Ndume, has voiced his disapproval of the Federal Government’s newly approved N70,000 minimum wage, stating it is insufficient for basic sustenance.

Ndume, recently removed from his position, pointed out that the new wage is barely enough to purchase a 50kg bag of rice, which currently averages over N70,000.

He urged President Bola Tinubu to reconsider and increase the minimum wage further to reflect the economic realities faced by Nigerians.

Despite being a member of the ruling All Progressives Congress (APC), Ndume has been outspoken about the shortcomings of Tinubu’s administration.

His critical stance led to his dismissal as Senate Chief Whip, a decision influenced by a letter from APC national chairman Abdullahi Ganduje and national secretary Basiru Ajibola.

The letter referenced an interview in which Ndume criticized the government and suggested his removal.
