At the resumed hearing before the Federal High Court in Abuja on Tuesday, Sowore informed the court that the evidence he intended to obtain from the DSS Director-General could instead be provided by another official of the security agency. The proceedings also marked the first personal appearance of the Attorney-General of the Federation and Minister of Justice, Lateef Fagbemi (SAN), who took over the prosecution of the case on behalf of the Federal Government. Fagbemi opposed the subpoena earlier issued to the DSS Director-General, arguing that the document at the center of the dispute was not authored by Ajayi but by another DSS officer who had already testified before the court. According to the Attorney-General, the letter in which the DSS advised Sowore to remove social media posts describing President Tinubu as a “criminal” had already been admitted as evidence on two separate occasions, making any further attempt to tender it unnecessary. He further noted that the author of the letter, Uwen Davis, had appeared before the court on July 22 and testified, adding that the document was already part of the court’s records. Counsel to Sowore, Olumide Fusika (SAN), challenged the Attorney-General’s participation in the case, contending that Akinlolu Kehinde (SAN) remained the counsel officially representing the Federal Government in the matter. After listening to arguments from both parties, the trial judge, Justice Muhammed Umar, adjourned the case until August 3 for the continuation of the defence.
