Enugu APC To Challenge 2023 Governorship Election Results In Supreme Court

Supporters of the governorship candidate of All Progressives Congress in the 2023 general elections in Enugu, Chief Uche Nnaji, have vowed to go to the supreme court to recover the mandate of their candidate.

This is contained in a statement signed by the state Secretary of the party, Mr. Robert Ngwu on Wednesday, in which he expressed dismay over the dismissal of Nnaji’s election petition by the Appeal court.

Ngwu said that tension flared on Tuesday as the Court of Appeal in Enugu dismissed Nnaji’s appeal against Gov. Peter Mbah and six others in the March 18 governorship election.

Advertorial

He explained that supporters of the APC candidate expressed deep disappointment, saying that the case should have been allowed to proceed on its merits rather than being dismissed on procedural grounds.

The state secretary hinted that the appeal, which sought to challenge the qualifications of the People’s Democratic Party (PDP) candidate and six others, was dismissed by the Enugu Governorship Election Petition Tribunal for premature filing, a decision that was later upheld by the Court of Appeal.

Ngwu said that Nnaji’s legal team and his supporters believed that the case was dismissed unfairly and prematurely, denying them the opportunity to present their arguments and evidence in support of their claims.

He, however, said that they asserted that the petition was validly filed within the designated timeframe, noting that any delays in serving the respondents should not have been attributed to them but to the court registry.

“Our legal officers have expressed concerns about the broader implications of the Court’s ruling. They argue that dismissing cases on procedural grounds rather than examining the substantive merits sets a worrisome precedent, potentially discouraging candidates from exercising their right to legal redress in future elections.

“The supporters have vowed to continue their fight for justice, indicating that they might explore other legal avenues to contest the Court of Appeal decision.

“Nnaji’s legal team has emphasized that they followed all prescribed procedures and timelines diligently. They maintained that their case has substantial merit and deserved a fair hearing.

“The dismissal, they argue, has left them disillusioned and raises questions about the impartiality of the judiciary, the aftermath of the Court of Appeal’s ruling has placed the judiciary under scrutiny, and calls for a thorough review of the judicial process in election-related cases.

“In a democracy that prides itself on the rule of law and fair legal processes, cases like this warrant close examination,” he said. (NAN)

Anambra Community Protests Death Of Youth In Police Custody

Members of the Aguleri community, Anambra East of Anambra State have protested against the death of a youth of the community, Mr Chidubem Ezenwa, in the police station.

It was learnt that the youth was taken into custody alongside three others three weeks ago after he and his friends were accused of violence in a hotel in the community.

He was said to have died in custody after being tortured by police operatives who arrested him.

The father of the deceased, Mr Sunday Ezenwa, who spoke to journalists during the protest, said his son came back from his base in Asaba, Delta State, to check on his friend who was involved in an accident when the police arrested him.

“After they were told of the death of his friend, he and his other friends went to a hotel to wait, while the body of their friend was being taken to the mortuary.

“In the process, one of them while reminiscing on the death of their friend broke a bottle. They later paid for the bottle when the hotel management protested, but the president general of the community, Ifeanyi Iloakasia, called in the police and got them arrested, and in the process, while in police detention, he died.

“Up till now, we have not been told anything about our son, and police have not released his body to us, if assuming he is dead already. We cannot accept that our son is dead. They should release his body to us if he is dead,” he said.

But Iloakasia who spoke with journalists, said he only called in members of the Anambra Vigilante Services (AVG) when the boys started breaking bottles in the hotel and chasing people around.

“I was not the one that called in the police, but the DPO told us that the boy and his friend have been on their wanted list for cultism,” he stated.

The state police command’s spokesman, DSP Tochukwu Ikenga, who confirmed the incident, said the victim was killed by a fellow suspect.

He said the victim was arrested for armed robbery and the person who murdered him also was arrested for armed robbery.

Ganduje Challenges CSO To Provide Evidence Of N10bn CCTV Loan

The immediate past governor of Kano State, Abdullahi Ganduje, has described as misleading and untrue, reports that his administration obtained N10bn loan for the installation of Close Circuit Television cameras in Kano metropolis.

In a statement on Tuesday in Abuja, the Commissioner for Information in the Ganduje administration, Muhammad Garba, said the story credited to a “non-existent” civil society organisation, the Coalition of Political Analysis Forum and Governance, was designed to discredit the former governor by “ignorantly” calling for an investigation on why the money was not spent on the project.

He said, “To further confirm that they are fake, the so-called organization knew nothing about the project and the hastiness with which their paymasters want them to be in the media exposes clearly, their intent.

“We, therefore, challenge them to provide evidence for the N10 billion Naira loan.

“For record purposes, when the last administration conceived the project, the State Executive Council and the Assembly formally granted approval bearing in mind the importance of the project in enhancing security in the state.

“Unfortunately, a Federal High Court in Kano, on July 1, 2022 granted an injunction restraining the government from obtaining the loan.”

The Civil Liberties Organisation Tuesday asked President Bola Ahmed Tinubu to stop receiving those with corruption cases at the Aso Rock Presidential Villa.

At a press briefing in Abuja, President of CLO, Igho Akeregha and the Executive Director, Ibuchukwu Ezike, said welcoming those with corruption cases is dangerous to efforts towards rebuilding the country.

“We appeal to President Tinubu whose election is being seriously challenged at the election petitions court to not convert the highest office of the president of the Federal Republic of Nigeria into a rehabilitation centre for politicians who put the country in this sorry state,” he said.

Help Us Recover N323bn Debt From FG – TETFund To Reps

The Executive Secretary of the Tertiary Education Trust Fund, Sonny Echono, Tuesday urged the House of Representatives to help it recover the outstanding debt of N323bn the federal government borrowed from the TETFund.

Echono made the call at a public hearing by an ad-hoc committee of the House probing the alleged missing of N2.3trn in TETFUND.

The House had, last Tuesday, set up the committee, headed by Oluwole Oke, to investigate the alleged abuse of N2.3trn generated from the Tertiary Education Tax by the Fund from 2011 to 2023.

Echono said the allegation was untrue.

He said the actual sum generated from education tax from 2011 to 2022 was N2.476trn out of which the Federal Inland Revenue Service retained N99bn as cost of collection.

He said the federal government, since 2013, had borrowed N371.3bn from the Fund and paid N48bn so far.

He said, “We do have challenges, but these challenges have nothing to do with fraud. They’re basically issues of governance. From the year 2011 to 2022, the total education tax collected by the FIRS as presented to us in their documentations, as confirmed from the statements we received from the Central Bank of Nigeria which we’ve also attached for the committee to peruse is N 2, 476, 733, 181, 679.75.

“Out of this amount, a total sum of N99bn was retained by FIRS as cost of collection leaving a balance of N2.37trn. So the total fund that had hit the education pool account at the CBN is N2.3trn from 2011 to date.

“However, the FG over time in the course of governance and to meet pressing needs has borrowed funds from these accounts. The total borrowing is approximately N371.339bn. These borrowings happened over time and most of the borrowings started in 2013.

But total repayment to this date is about N48bn. Last year, N12.8bn was given to us, this year another N12.89bn was given to us.”

Enocho also said consultations were ongoing to suspend foreign scholarships as a result of the current exchange rate.

He said the tax accruable to the fund was generated by the FIRS and the Fund’s account was domiciled in the CBN.

According to him, some of the tax comes in foreign currencies to CBN, but when it is time to pay fees for scholars abroad, the apex bank insists on TETFUND sourcing forex by itself.

He urged the committee to compel the CBN to allow TETFUND access to forex to pay fees when due.

He said the Fund had earlier decided that only limited courses where it did not have the capacity in Nigerian institutions would qualify for foreign sponsorship.

“Most of our training now will be done locally through our experienced, first-generation universities and other specialised universities based here. This way we can retain our resources in-house and cope with the change of foreign exchange variation.”
