N10.8bn Fund: CACOL Calls On EFCC, Others To Investigate Abiodun, Adebayo’s Feud

The anti-corruption organisation, Centre for Anti-Corruption and Open Leadership (CACOL), has called on Nigerian anti-graft agencies to wade into the allegation of diverted public fund brought by impeached chairman of Ijebu East Local Government, Hon. Wale Adedayo against Governor Dapo Abiodun of Ogun State.

Recall that Adebayo petitioned former Ogun state governor, Olusegun Osoba, that the N10.8 billion statutory Federal Allocation due to the state’s local governments in the last two years was diverted by Abiodun.

Adabayo was consequently sacked and arraigned before a magistrate’s court in Abeokuta, the Ogun state capital for allegedly making false allegations against the governor following a petition sent to the police by the state government.

Reacting to the saga, CACOL, in a press statement by its Chairman, Debo Adeniran, on Tuesday called on “the Anti-Corruption Agencies, ACAs – Economic and Financial Crimes Commission (EFCC), Independent Corrupt Practices and Other Related Offenses Commission (ICPC), to swing into action, track the FAAC allocations and determine where the funds went to.”

It said, “Even if the Governor is immune, this does not cover investigations, and his commissioners, aides, managers of JAAC can be invited, apprehended, and prosecuted, if found culpable of diverting public funds!”

“The seemingly unending drama in Ogun State over ‘impeached’ Chairman of Ijebu East Local Government, Hon. Wale Adedayo’s allegation of diversion of statutory Federal allocations to Local Government Areas by Governor Dapo Abiodun calls for diligent intervention of the Anti-Corruption Agencies (ACAs) in the country especially in order to rail in executive, financial recklessness, and stop the state from degenerating into state of lawlessness, impunity and anarchy that may encourage citizens to have confidence in resorting to self-help,” the statement read.

“We are alarmed by the use of State Security Institutions to harass the Chairman, Wale Adedayo, whom we gathered has again been arrested by the Police on the strength of a petition by Governor Dapo Abiodun. It is our expectation that the Police are aware that Adedayo is a Whistleblower in this case, who should be protected by security agencies. Also, his inalienable rights under constitutional democracy which include that he cannot be lawfully detained by the Police for more than twenty-four hours, should be fully respected.

“It would be recalled that the Executive Chairman of Ijebu East Local Government Area Council, Hon. Wale Adedayo on 28, August 2023 wrote a petition to Chief Olusegun Osoba and the Economic and Financial Crimes Commission (EFCC), wherein he accused Governor Dapo Abiodun of diverting Local Government Council funds in Ogun State. The funds allegedly diverted from the Federation Account Allocation (FAAC) by the State Government covers all statutory allocations from 2021, running into multi-billion Naira.

“Subsequently, the whistle-blowing Chairman, Adedayo was unceremoniously impeached in suspicious circumstances. The State Government deployed state machinery of coercion to arrest and detain the Council Chairman, Adedayo, and as well intimidate the Councillors to carry out the impeachment processes.

“On September 2, 2023, Wale Adedayo was arrested by the Department of State Security Services operatives on the account of a spurious petition by the State Government, but he was later released after four days in detention, paving the way for the purported impeachment.

As this may still be subject of litigation processes, we refrain from further comments on the impeachment.

“On Monday September 25, 2023, the Governor orchestrated another arrest of Hon. Wale Adedayo by Officers of the Ogun State Police Command. It is widely reported that Adedayo was detained on account of a petition by Prince Dapo Abiodun. In the said petition, the Governor accused Adedayo of defamation of his person, denigration of the Office of the Governor and, public incitement to destabilise peace and order in the State.

“As an anti-corruption watchdog, we call on all well-meaning leaders and citizens of the Gateway State to take a critical interest in this case. The State is in dire strait, with huge social infrastructural stagnancy and collapse. The scarce allocations to the grassroots tiers of government must therefore percolate to the local communities for the dividends of democracy to be felt by common citizens.

“The issues contained in the Allegations of Hon. Wale Adedayo, are not treasonable, felonious, and should not create security apprehension. They are purely issues of dire necessity to tackle corruption as a hindrance on our social, human development index.

“We strongly call on the Ogun State Government to stop chasing after shadows but should squarely explain to the public and anti-corruption agencies, how the statutory allocations to the Local Councils were disbursed. We do not need to remind anyone that immunity does not protect the Governor from being investigated.

“We are prepared to assemble conscientious citizens, legal activists, civil society communities to invoke the “Freedom of Information Act” to demand accounts of the disbursement of FAAC Local Government Council Funds for the period in question in Ogun State. As the Governor claimed that he has disbursed the Funds to the Local Government Councils and the Chairman claimed the Funds are diverted, never got to the Councils, the Anti-Corruption Agencies can effectively track these funds.

“The relative peace of the Gateway State should not be disrupted on the account of this simple issue of corruption and diversion of public funds. If our institutions are not cosmetics parades, we are confident that these funds can be tracked and coughed out if cornered into private hands.”

Lagos LP Guber Candidate, Rhodes-Vivour Rejects Tribunal Verdict, Heads To Appeal Court

The governorship candidate of the Labour Party in Lagos State, Gbadebo Rhodes-Vivour, has rejected the ruling of the election petition tribunal affirming the victory of Governor Babajide Sanwo-Olu.

Rhodes-Vivour, in a statement he personally signed on Tuesday, said the judges of the tribunal erred in law, adding that their judgment suggested that a clear constitutional provision in the electoral process has no meaning.

He further expressed his readiness to proceed to the appeal court to seek redress.

The statement read, “Having carefully listened to the judgment of the Honourable Judges of the Tribunal, we believe they, like the learned jurist quoted above stated, have erred in law. The judgment of the Tribunal suggests, erroneously in our view, that a clear constitutional provision in the electoral process has no meaning.

“While the disappointment and concern that have arisen from this particular judgment may run deep, we would like to assure our teaming supporters that this verdict is certainly not the final word on the matter. It is just one step in a larger legal process.

“Our democracy is built on the principles of justice, accountability, and the rule of law, including an appeal process that exists to ensure that mistakes by judges are reviewed by appellate courts.

“The outcome at the Tribunal will not in any way diminish our faith and confidence in the Nigerian Judiciary, rather it will strengthen our resolve to keep working with other patriots to bring about a new set of empathetic leadership that will create economic opportunities for Lagosians to fully realise their God-given potentials.

“As we all know, democracy is the cornerstone of any free and just society. It is the voice of the people, and it is through this process that we express our will and choose the leaders who will guide our communities and our nation. Yet, it is also a process that demands our vigilance, our resilience, and our unyielding faith in its sanctity.

“The essence of democracy lies not only in our ability to vote but also in our capacity to defend the integrity of that vote. Consequently, our laws allow Governorship candidates to challenge the decisions of the Electoral Tribunals at the Court of Appeal, and up to the Supreme Court.

“In the light of this, my lawyers have been instructed to appeal this judgment, as we remain confident of getting substantial justice at the appellate courts.”

He also urged his supporters to remain calm, peaceful, and law-abiding while appreciating their support.

Tribunal Announces Date For Taraba Governorship Judgment

There is tension in Taraba State, especially among the political actors as the governorship election petition tribunal sitting in Jalingo, the State capital, is set to deliver judgement.

The tribunal has finally slated September 30 to rule on the petition filed by the New Nigeria People’s Party, NNPP, and its gubernatorial candidate in the 2023 general election, Professor Sani Yahaya, against the Peoples Democratic Party, PDP, and Governor Agbu Kefas.

NNPP and its guber candidate had dragged both the PDP and Governor Kefas to the tribunal on the ground that the election was marred by pockets of malpractices.

Yahaya prayed the tribunal to nullify the entire exercise and allow for a fresh governorship election in the state.

The date for the judgement is coming barely two weeks after both parties adopted their final written addresses before the tribunal chaired by Justice G.A Sunmonu.

Some persons, especially from the PDP camp who spoke with our reporter, said they have every reason to be anxious about the coming judgement.

The party’s spokesperson, Andeta’rang Irammae, said, “there is anxiety because of the current trends of dispensing justice in Nigeria.

“There is every reason to be anxious, but we are prayerful and we believe God will see us through.”

On their part, some members of the NNPP also confirmed that there is anxiety in the party’s camp.

Just In: Tribunal Strikes Out APC’s Petition Challenging Victory Of Enugu LP Senator, Chukwu

The national assembly election Petitions Tribunal sitting in Enugu on Wednesday struck out the petition filed by the candidate of the All Progressives Congress, Ada Ogbu challenging the declaration and return of Senator Sir. Kelvin Chukwu of the Labour Party.

The Independent National Electoral Commission, INEC had declared Senator Chukwu winner of the march 18 election for Enugu East Senatorial Zone after he garnerd a total of 69,487 votes to defeat his closest rival who was also Enugu former governor, Chimaroke Nnamani of the PDP.

Ada Ogbu, candidate of the APC who came distant third in the election is alleging non compliance with the electoral act, 2022.

Delivering her judgment on the petition, the three man tribunal agreed that the issue of nomination is a pre-election matter which the court has no jurisdiction to entertain.

Daily Gazette correspondent reports that the court further ruled that the Petitioners couldn’t prove their case as it was grossly incompetent and vague.

It however struck out all the grounds of the petition and subsequently dismissed same for lacking in merit.

BREAKING: Tribunal Upholds Victory Of Enugu LP Senator, Sir. Kelvin Chukwu, Dismisses Chimaroke Nnamani’s Petition For Lacking In Merit

The national assembly election petitions tribunal sitting in Enugu has struck out the suit filed by Chimaroke Nnamani, candidate of the Peoples Democratic Party (PDP), challenging the victory of Senator Kelvin Chukwu.

The Independent National Electoral Commission (INEC) had declared Chukwu, candidate of the Labour Party (LP) as the winner of the Enugu East Senatorial district poll after he secured over 69,000 votes to defeat former governor of Enugu state, Chimaroke Nnamani who got about 49,000 votes.

However, Nnamani had alleged that the election was marred by over-voting, irregularities, election malpractices and non-compliance with the electoral guidelines.

The founder of the Ebeano political family also urged the court to declare him the rightful winner of the election or declare as invalid the results of the polls.

Delivering its ruling on Wednesday, the tribunal upheld Senator Kelvin Chukwu’s victory.

The tribunal also awarded a cost of N500,000 against the petitioners in favour of the three respondents, Kelvin Chukwu, Labour Party and INEC.

The three man honourable Justices unanimously dismissed the petition for being vague, lacking in merit, incompetent, generic and academic exercise.

Police Arrest LG Chairman Who Accused Gov. Abiodun Of Diverting Funds

The Police have arrested impeached Chairman of Ijebu East Local government, Wale Adedayo, over a petition allegedly written against him by the State Government.

Adedayo had accused Governor Dapo Abiodun of diverting statutory Federal allocations of all the 20 LGs in the state.

He also petitioned the Economic and Financial Crimes Commission (EFCC), seeking Abiodun’s probe on the allegations.

Adedayo was later suspended by the seven councillors from the LG following allegations against the governor, and also held and grilled for three days by the Department of State Security (DSS), Ogun Command, in Abeokuta.

He was impeached on September 14 by five out eleven Councillors in the LG.

Adedayo on Monday disclosed his arrest by the police via a Facebook post on his timeline, adding that he is ready to die.

“Son of man is being taken to Ogun State Police CID at Eleweran, Abeokuta. They claim the State Government wrote a petition against me. If it is death, I follow the path of the Patriarchs. Ase di owo Olodumare!,” he wrote.

When contacted, the Police Spokesman , Omolola Odutola, said she was not aware of the arrest.

Odutola promised to get back to our correspondent as soon as she is briefed.

Last week, Governor Abiodun vowed that he would ensure that Adedayo is held responsible for the allegations against him.

“There are two things; he lied against me as the governor, he lied against me as Dapo Abiodun, he spoilt my name, and he tried to incite the public against the government. Wale Adedayo has to answer all these allegations one after the other,” Abiodun said.

MohBad Was Brought In Dead, Didn’t Die In Our Facility, Lagos Hospital Releases Statement

Perez Medcare Hospital, where singer Ilerioluwa Aloba aka MohBad was allegedly taken to, has released a statement concerning the singer’s death.

In the statement shared on its Instagram page on Monday night, the hospital stated that the singer was brought in dead at the hospital.

The hospital also debunked rumours that the singer was admitted into the hospital.

The statement partly read, “The attention of the management of Perez Medcare Hospital has been drawn to the misleading and false information being circulated in some social media platforms that Mr. Ilerioluwa Oladimeji Aloba (AKA Mohbad) died in our medical facility.

“We consider it pertinent to put on record that at about 04:30pm on the 12th of September 2023, the lifeless body of Mr. Ilerioluwa Oladimeji Aloba (AKA Mohbad) was brought to our medical facility and our medical team immediately sprang into action and after assessment, it was discovered that there was no sign of life, no central or peripheral pulse, no heartbeat, no recordable vital signs and his pupils were fixed and dilated.

“On attempting CPR (Cardiopulmonary Resuscitation), rigor mortis (stiffening of some parts of the body in relation to death) was observed and the persons who brought him to our facility were informed that it was a case of BID (Brought in dead).

“Upon enquiry about the circumstances leading to the emergency, our team was informed that the deceased was being treated at home by a nurse and that she administered injections on him.

“Our team thereafter advised that the body be taken to the nearest Government Hospital where he can be deposited in the morgue.

“Let it be known that Mr. Ilerioluwa Oladimeji Aloba (AKA Mohbad) was not a patient of Perez Medcare Hospital and was never admitted at our hospital at any material time whatsoever.

“Also, the nurse who was said to be administering treatment on him at home is not a staff of Perez Medcare Hospital and the video of the medical facility circulating In the media space in which the late Mr. Ilerioluwa Oladimeji Aloba (AKA Mohbad) is seen alive and receiving treatment is not Perez Medcare Hospital”.

French Troops To Vacate Niger – Macron

The military junta in Niger has cheered up the announcement that France will pull its troops out of the country by the end of the year as “a new step towards sovereignty”.

The statement came hours after French President Emmanuel Macron announced on Sunday that Paris would soon withdraw its ambassador from Niger, followed by its military contingent in the coming months.

“This marks a historic moment that reflects the resolve and determination of the Nigerien people. This Sunday, we celebrate a new step towards the sovereignty of Niger,” said a statement from the country’s military rulers, who seized power in late July by overthrowing President Mohamed Bazoum on July 26.

“The French troops and the ambassador of France will leave Nigerien soil by the end of the year.”

Earlier Sunday, before Macron’s announcement, the body regulating aviation safety in Africa (ASECNA), announced that Niger’s military rulers had banned “French aircraft” from flying over the country’s airspace.

Finally, Ondo Assembly Serves Deputy Governor With ‘Impeachment Notice’

Ondo state deputy governor, Hon Lucky Aiyedatiwa, has finally been served the allegation letter of alleged gross misconduct.

Aiyedatiwa was expected to respond to the letter within seven days.

Recall that the assembly directed the Clerk to write the deputy governor over the allegation of gross misconduct levelled against him while he held sway as the acting governor of the state.

Some members of the assembly have petitioned the deputy governor over the allegation of gross misconduct.

lt was alleged that Aiyedatiwa reportedly approved N300 million for the purchase of a bulletproof SUV for his personal use.

Recall that the governor travelled to Germany for medical treatment for three months.

Aiyedatiwa was alleged to have ordered the N300 million to be sourced from the Palliative fund, which was from the Federal government to the state in order to cushion the effect of the removal of fuel subsidy.

But Aiyedatiwa has since denied the allegation, describing it as a fabricated lies.

However, vanguard gathered that the letter was received in his office at exactly 316pm today( Monday) after several days of evading service.

Reports had it that members of staff of his office refused to collect the allegation letter from the Clerk of the House, Jaiyeola Benjamin saying they were acting on instructions.

However, Aiyedatiwa, had this morning in a statement, said that he was yet to receive the letter.

According to him ” It is pertinent to put on record that as of today, Monday, September 25, 2023, I have not received any official communication or any “letter of allegations of gross misconduct” from the Ondo State House of Assembly.

“I find it especially worrying that the spokesman of the House of Assembly would go on national television to speak on such a matter without any evidence to show that such letter has been delivered to me. More disturbing is the fact that even when he was asked if the letter had been delivered, he gave no coherent answer.

“A sensitive constitutional matter of this nature; the impeachment process should not be conducted on the pages of newspapers and television screens.

“In effect, I reiterate that if such “letter of allegations of gross misconduct” against me exists, I have not seen it and I have not been served. I therefore urge Mr. Speaker, The Honourable Chief Judge of Ondo State and members of the public to take note.
