Supreme Court Reserves Judgment On FG’s Suit For Local Government Autonomy

The Supreme Court has reserved its judgment on the Federal Government’s lawsuit seeking full autonomy for the country’s 774 Local Government Areas (LGAs).

A seven-member panel, headed by Justice Garba Lawal, scheduled the matter for judgment after the governors of the 36 states, represented by their respective Attorney-Generals, presented their arguments.

The states, through preliminary objections, requested the dismissal of the suit, arguing that the Attorney-General of the Federation (AGF) and Minister of Justice, Prince Lateef Fagbemi, SAN, did not have the legal standing to file the suit.

They also claimed that the AGF violated their right to a fair hearing by failing to provide them with a copy of a further affidavit filed in support of the case.

Several states highlighted that they already have democratically elected local government officials, asserting that the Federal Government’s suit constituted an abuse of judicial process.

After hearing from both sides, Justice Lawal’s panel indicated that it would announce the date for the judgment later.

The Federal Government’s suit seeks the Supreme Court’s approval for full autonomy for all LGAs, recognizing them as the third tier of government.

It also requests an order preventing state governors from unilaterally dissolving elected local government leaders and demands that local government funds be directly disbursed from the Federation Account, bypassing the allegedly unconstitutional joint accounts managed by state governors.

Senator Okechukwu Ezea, a prominent Labour Party lawmaker representing Enugu North in the Senate, has challenged a report by Vanguard that listed him among 24 senators without a bill one year into the 10th National Assembly.

The report’s headline stated, “24 senators have no bill in one year,” referring to the period between June 13, 2023, and March 31, 2024.

However, Senator Ezea argued that this timeframe does not constitute a full year and noted that he sponsored a bill on April 30, 2024.

Additionally, he emphasized his active participation through raising several motions and contributing to debates.

In a statement by his Special Adviser (Media), Mr. Aniebo Nwamu, Senator Ezea clarified: “On April 30, 2024, Distinguished Senator Ezea’s bill was listed No. 5 on the Senate Order Paper for the day. The bill, entitled ‘The Agricultural Research Council Act (Amendment) Bill, 2024,’ passed its first reading on the floor of the Nigerian Senate.”

The bill aims to amend the Agricultural Research Council Act to include the creation of the Federal College of Agriculture in Adani, Uzo-Uwani Local Government Area, Enugu State, and is progressing towards passage into law.

Furthermore, Mr. Nwamu highlighted that video evidence of Senator Ezea raising motions and engaging in debates is widely available online, countering claims of his inactivity.

Court Sets June 26 For Hearing On Suit Seeking Ganduje’s Removal As APC Chairman

The Federal High Court in Abuja has scheduled June 26 to hear a lawsuit challenging the appointment of Dr. Abdullahi Ganduje as the National Chairman of the All Progressives Congress (APC).

Justice Inyang Ekwo set the date after the plaintiff’s lawyer, Benjamin Davou, requested additional time to respond to Ganduje’s preliminary objection.

The lawsuit, filed by the North Central APC Forum led by Saleh Zazzaga, questions the legality of Ganduje’s appointment, arguing it violates the party’s constitution since Ganduje hails from Kano State in the North West, rather than the North Central geo-political zone.

The suit is identified as FHC/ABJ/CS/599/2024 and lists Ganduje, the APC, and the Independent National Electoral Commission (INEC) as defendants.

During the hearing on Thursday, Davou noted that he had just received Ganduje’s preliminary objection and counter affidavit, necessitating more time to respond.

Consequently, Justice Ekwo adjourned the case until June 26, stating that the preliminary objection and the main suit would be heard simultaneously.

He also noted that any party absent on that date would have their documents considered as adopted.

The plaintiff’s main suit seeks to prevent Ganduje from continuing as APC chairman and requests an order for INEC to disregard all actions taken by the APC under Ganduje’s leadership since his appointment on August 3, 2023.

The Forum contends that Ganduje’s appointment contravenes Article 31.5(1)(f) of the APC constitution, which stipulates that any replacement should come from the same geo-political zone as the predecessor.

Ganduje replaced Sen. Abdullahi Adamu from Nasarawa State in the North Central zone.

Additionally, the plaintiffs argue that Ganduje’s appointment without a democratically conducted election violates Article 20(1) of the APC constitution.

They further assert that the National Executive Committee (NEC) lacks the authority to appoint the national chairman, a power reserved for the party’s National Convention per Article 13 of the APC constitution.

The plaintiffs are asking the court to declare Ganduje’s appointment illegal and to uphold the party’s constitutional requirement for filling vacancies through democratic processes.

Appeal Court Dismisses Contempt Case Against EFCC Chairman, Imposes N1 Million Fine On Yahaya Bello

The Court of Appeal in Abuja has dismissed a contempt charge filed by former Kogi State Governor Yahaya Bello against the Chairman of the Economic and Financial Crimes Commission (EFCC), Ola Olukoyede.

The court also imposed a cost of N1 million on Bello.

In a unanimous decision by a three-judge panel, the appellate court overturned a previous judgment by the Kogi State High Court, which had supported Bello’s contempt case against the EFCC chairman.

The Kogi State High Court, presided over by Justice Jamil Abdullahi, had previously summoned the EFCC Chairman to explain why he should not be jailed for allegedly disobeying a court order related to Bello’s ongoing legal troubles.

This summons followed a suit and motion filed by Bello, who faces 19 counts of charges from the EFCC, including money laundering, breach of trust, and misappropriation of N80.2 billion.

Bello claimed that the EFCC chairman had ignored an interim order issued by the Kogi State High Court on February 9, which prohibited the agency from arresting him.

Despite this order, the EFCC obtained an ex parte order from the Federal High Court in Abuja to proceed with Bello’s arrest and trial.

In response, Bello’s legal team filed a form 49 contempt charge, seeking to imprison the EFCC chairman for allegedly disobeying the court order.

Justice Abdullahi had ordered Olukoyede to appear in court to justify why he should not be held in contempt.

However, Olukoyede challenged the Kogi State High Court’s decision in the Court of Appeal, arguing that no court has the authority to prevent a law enforcement agency from carrying out its duties.

Delivering the lead judgment, Justice Joseph Oyewole of the Court of Appeal affirmed that courts cannot impede the EFCC or any other law enforcement agency from fulfilling their statutory responsibilities.

He emphasized the principle of the separation of powers, stating, “A court of law cannot preclude the EFCC or any law enforcement agency from investigating and prosecuting crime.”

The appellate court granted Olukoyede’s appeal and dismissed the preliminary objection filed by Bello.

It also imposed a fine of N1 million on the former governor for his unsuccessful legal challenge.

The decision reinforces the autonomy of law enforcement agencies in performing their duties without judicial interference, marking a significant ruling in the ongoing legal battles involving the EFCC and political figures in Nigeria.

INEC Publishes Final List For Ondo Guber As Seven Parties Announce Candidate Replacements

The Independent National Electoral Commission (INEC) has released the final list of candidates for the November 16 Governorship Election in Ondo State, revealing that seven out of the 17 participating political parties have made candidate replacements.

According to a statement by INEC’s National Commissioner for Information and Voter Education, Sam Olumekun, two parties—the New Nigeria Peoples Party (NNPP) and the Social Democratic Party (SDP)—conducted fresh primaries to replace both their gubernatorial candidates and running mates by the June 10, 2024 deadline.

Additionally, five parties replaced only their running mates.

These parties are the African Action Congress (AAC), the Action Democratic Party (ADP), the Peoples Democratic Party (PDP), the Peoples Redemption Party (PRP), and the Zenith Labour Party (ZLP).

Olumekun highlighted a notable absence of female candidates in the election.

However, he mentioned that one candidate from the African Democratic Congress (ADC) is a person with a disability (a paraplegic).

“The list has been published at our office in Akure and also uploaded to our website and social media platforms for public information,” Olumekun stated.

With the final list of candidates now published, the next phase is the commencement of electioneering campaigns.

As outlined by Section 94(1) of the Electoral Act 2022, public campaigns by political parties are permitted to begin not earlier than 150 days before polling day and must end 24 hours prior to that day.

Accordingly, political parties can start their public campaigns from Wednesday, June 19, 2024, and must conclude by midnight on Thursday, November 14, 2024.

Olumekun reminded candidates, party agents, and supporters to adhere to the legal provisions and INEC guidelines during campaigns.

He emphasized the need for civility and decorum, urging parties to avoid inciting language, violence, voter inducement, and other infractions as stipulated in Sections 92-97 of the Electoral Act 2022.

Permit me to reel out some of the projects he initiated and completed; Rehabilitation of 5km Ako-Nike Road, Youth empowerment programme tagged PPNTAYI—Professor Paul Nnamchi Techhub and Youth Innovation (PPNTAYI) under which over 500 youths have been trained in computer literacy. The target of the programme is to expose the youths within the Senior primary to senior secondary school levels in information computer technology, (ICT). They are usually trained in different computer packages to prepare them for future challenges.

Professor Nnamchi has also procured and Installed many solar Streets Lights both in Urban and Rural areas of the constituency. He is constantly engaging with his constituents to gather information about their needs and challenges and these have helped him in carrying out the following life touching projects which include the provision of free School Uniforms for indigents pupils in public schools, facilitation of admission of several students into different federal/state universities and other institutions of higher learning. He also awarded the payment of bursaries to over 50 Students.

The Labour Party, (LP) parliamentarian equally awarded university scholarship to 250 students from the constituency and facilitated the employment of over 10 members of the constituency into federal government establishments within his first anniversary as a legislator.

Hon Prof Nnamchi who thoroughly feels the pulse of his people understood that it would be difficult for some households to celebrate 2023 Christmas and new year with rice and decided to procure and distributed over 4500 bags of rice to members of his constituency.

Hon. Professor Paul Nnamchi’s first year in office stands as a testament to his unwavering dedication to serving his constituents. ‘US Presidents Have Fallen Several Times’ – Presidency Defends Tinubu’s Slip

Federal Permanent Secretary Suspended Over Sexual Harassment Allegations

The Permanent Secretary of the Ministry of Foreign Affairs, Ambassador Ibrahim Adamu Lamuwa, has been suspended following allegations of sexual harassment.

The Office of the Head of Service ordered his suspension, according to a high-ranking source within the ministry.

Daily Sun reports that Lamuwa was directed to step down by the Office of the Head of Service and was given until last Friday to relinquish his position.

Benaoyagha Okoyen, the former Nigerian Ambassador to Cuba, assumed the role of acting head on Monday.

The complaint stemmed from a petition filed by Mrs. Simisola Fajemirokun Ajayi, a married employee of the ministry, who reported the permanent secretary’s misconduct through her lawyer, Mr. Femi Falana (SAN).

In her petition, Mrs. Ajayi detailed the inappropriate behavior of Ambassador Lamuwa and urged Minister Tuggar to investigate the matter.

This led to the official suspension of Lamuwa as the investigation proceeds.
